I've always imagined if I invented a time machine, that the biggest value it could provide would be to videotape past murders and come back to today to be able to display the truth. Hoffa, Kennedy, etc. Put all of the bullshit to rest. How would you like to have a video of Knox's roommate murdered today?

In theory the prosecution can appeal. Amanda Knox has to face a slander trial brought by the police for accusations she has made against them, theoretically that begins next month

Color me in the minority, but I actually think "not enough evidence to prove guilt" is exactly right.

 

Let's face it, the Italians

-- completely donked evidence collection at the crime scene

-- completely donked *security* at the crime scene,which

-- allowed possible evidence (e.g., bra clasp) to be comprimised

-- completely donked computer-forensics

("accidentally" wiped the laptop while checking activities on the night in question)

-- put a prosecuter on the case who was already indicted for making up evidence

-- who proceeded to make up "evidence"

-- and got a conviction based on DNA "samples" which were well outside the international standards for evidence.

etc., etc., etc.

 

I don't know if she did it or not. I tend to believe "not". But the sad truth is, the italians screwed up the case so badly, we'll never know for sure.

I thought NBC said she was sentenced to 3 yrs for that slander, and got released as time served ? This prosecutor has a habit of re-charging people, so she better pick up a slice to-go and get the h-ll out of Dodge !

Yup. She got convicted of slander for stating that the police mistreated her... which they *did*, according to international standards, but she wasn't allowed to bring any evidence into the court to prove it. That's just... wrong... on so many levels. She said the truth, and got convicted of slander.

 

That's one of those tidbits that makes me really glad I am an American. As badly flawed as our system is, it is a whole lot better than that.

 

ETA: the *parents* are still under indictment for slander, due to be in court in 2012. Maybe that's the upcoming slander trial you're thinking of?

1) Amanda defamated the Italian Police by saying that they beat her - for which she has been found guilty

2) Amanda accused Patrick Lumumba (her boss) - case still pending

3) Knox parents in the British media.

No we don't.

 

Looks like over there, your trial jury is made up of a bunch of judges, but your appeal jury is a bunch of citizens (peers) with two judges, who mostly advise them.

 

You don't get a trial by your peers until the appeal.

Sorry, but if you base your opinion on the whole of Italy on this one issue, then you are missing out on a great country and experience.

I'm sure if we looked we could find many cases in the US (or Aust or Kumfuckistan) where the legal system is not perfect.

Hardly a valid reason to not visit these places.

53 hours over the course of 4 days. Four days is 96 hours, so she was questioned for a little more than 50% of the time.

Even as a 20 year old you don't make up false statements naming people as murderers just because you are being "interrogated"

 

Public opinion in Italy is very much she is guilty (ie definitely present in the house at the time of the murder), as I posted the reaction outside the court was very negative, the Knox family have created a big media circus a lot of which is anti-Italian.

Lumumba will be paid off as soon as Amanda is out of italy..

 

The court ruled Knox must pay Lumumba's legal costs and compensation, I hope she does so. That is not paying him off, that is compensating him for the damage done by fabricating a story and trying to stitch him up for murder - in order to save herself and her buddies. The court said the 4 years she had served covered the 3 year sentence she would have received for falsely accusing him.

 

There is a further defamation case lodged by the police in responce to Knox's claim she was beaten - this is due to be heard next month and the general view is that she will not return to Italy to face that trial.

Seems harsh on the Kercher family, suddenly they have to pay back 3.6 million euros between them, still a dead daughter / sister.

 

Maybe the money does not come back from the family, maybe they keep their money, and the Italian judicary pay the money back to Knox.

You definitely shouldn't go back to Italy. You've slandered the Italian justice system by saying that it's for sale. Such slander will get you at least three years in the slammer, if this case is anything to go by.

You have a point. Back "in the day" we'd depose people for days in big cases and just physically and emotionally wear them out "to get to the good stuff." That was with lawyers present for the witness who could call breaks at any time, take a lunch break, go to the bathroom, etc. Finally, the courts determined that that just wasn't fair to the witnesses, so we are now limited to seven hours in the federal system and six hours in our state system.

 

I can't imagine how draining it would be, both physically and mentally, to be locked up in a room with multiple people grilling you for 12 to 13 hours a day for days on end.

 

I'm not convinced that they should not have done that, but it sure would have sucked to be her going through it alone.

 

By the way, one day OJ will find the real killer.

First she tells them she was there, and she saw Patrick kill Meredith. (You see your friend murdered, and you only tell the police 12 hours later, once you've cleaned the flat???)

 

Then she says she didn't see it happen. She was in the kitchen and she heard the scream. (Once again, she only notifies the police 12 hours later)

 

Next she tells them she wasn't there, and she imagined she heard Meredith scream.... (WTF??? Where did the other two stories come from)

 

Then she was at Rafa's, wacked out on scooby snacks....

 

When things are so inconsistant, would you just release her, or would you ask her again.....

 

Really - do you want to spend some time reading the actual facts, rather than the soundbites of the American media???

Really, if you spent some time reading actual facts, you might discover that her initial interrogation was 14 hours long and conducted in Italian, a language she had only studied for two months. She was not allowed an interpreter or a lawyer. At the end of that interrogation she signed a confession, written in Italian. Those are facts, as determined by Italy's highest court (although the prosecutor denies them, as he denies her claims that she was withheld food, water and the use of the toilet until she confessed). It'd be a miracle if anyone would be able to get a consistent story across in those circumstances.

 

Later that confession was excluded from use in her criminal trial, since there was good reason to believe she didn't know what the hell it was she signed. But it was used in her civil trial, which was held concurrently with the criminal trial, using the same jury. But please keep defending the Italian justice system to us ignorant, benighted Americans.

Really, if you spent some time reading actual facts, you might discover that her initial interrogation was 14 hours long and conducted in Italian, a language she had only studied for two months. She was not allowed an interpreter or a lawyer. At the end of that interrogation she signed a confession, written in Italian. Those are facts, as determined by Italy's highest court (although the prosecutor denies them, as he denies her claims that she was withheld food, water and the use of the toilet until she confessed). It'd be a miracle if anyone would be able to get a consistent story across in those circumstances.

 

Later that confession was excluded from use in her criminal trial, since there was good reason to believe she didn't know what the hell it was she signed. But it was used in her civil trial, which was held concurrently with the criminal trial, using the same jury. But please keep defending the Italian justice system to us ignorant, benighted Americans.

I'd wonder how'd you hold up, being interrogated 13 1/4 hours a day for 4 days.. with no one there to say "enough"

 

 

Really, if she'd only told them one story, the truth, she would have only been in there being questioned for 6 hours or so. But she kept changing it.

Speaking for myself I have followed what has been reported in the UK press. What Thiepval says is what I recognise as the chain of events.

 

The Knox camp has done a very good job generating a media frenzy around the case and the inference that the Italian police and justice systems are incompetent.

 

Whether the DNA evidence was gathered poorly (it has been found it was) whether it was present in sufficient quantities is in my view a sideline. There are far too many other inconsistencies and additional evidence that points to Knox and her boyfriend being involved.

I'll not argue the inconsistencies, you're correct that they exist. Why they exist is still very much open to interpretation, and a reasonable person could infer Knox's complicity, prosecutorial misconduct, simple language barriers, and many other points.

While I love almost every aspect of Italy (I was deployed there militarily) - its government, especially its courts, are locally notorious for inefficiency and making decisions outside careful consideration of fact.

 

I'd suggest that prudence warrants an understanding and acceptance that there are "unusual" factors on both sides of this story.

what would really be interesting would be to see a transcript of all of her interrogations.. I'm sure the exorcism the prosecutor performed would have been interesting..

If an interpreter is not available then all statement or questioning and answers have no merit in the case. I beleive its very staright forward, if she did it or not it doesnt matter, the italians fucked up.

It is true, and the written statement was excluded in the original criminal trial. However, it was used in the civil trial, which peculiarly was held concurrently with the criminal trial, using the same jury.

picked up or not the law is the law. a judge is there to make sure the laws are followed, as soon as you make a mistake such as this it gets all tossed out.

I love Italy. My best friend since Junior High is Italian. He will tell you the same as I, the Italian justice system IS inept. His dad will tell you the same.

 

Now whether the bitch stabbed the other, I don't know. Maybe, maybe not. The Italian police have succeeded in spectacular fashion making sure nobody ever really knows.

No you didn't fix it. I was right the first time.

 

Trying to frame an innocent man for murder isn't an inconsistency.

 

The worst thing you can say happened to Knox is she served 4 years instead of the 3 she should have done.

 

The "interrogation" issue is a fabrication from the Knox team.
