      Sailing Anarchy is a very lightly moderated site. This is by design, to afford a more free atmosphere for discussion. There are plenty of sailing forums you can go to where swearing isn't allowed, confrontation is squelched and, and you can have a moderator finger-wag at you for your attitude. SA tries to avoid that and allow for more adult behavior without moderators editing your posts and whacking knuckles with rulers. We don't have a long list of published "thou shalt nots" either, and this is by design. Too many absolute rules paints us into too many corners. So check the Terms of Service - there IS language there about certain types of behavior that is not permitted. We interpret that lightly and permit a lot of latitude, but we DO reserve the right to take action when something is too extreme to tolerate (too racist, graphic, violent, misogynistic, etc.). Yes, that is subjective, but it allows us discretion. Avoiding a laundry list of rules allows for freedom; don't abuse it. However there ARE a few basic rules that will earn you a suspension, and apparently a brief refresher is in order. 1) Allegations of pedophilia - there is no tolerance for this. So if you make allegations, jokes, innuendo or suggestions about child molestation, child pornography, abuse or inappropriate behavior with minors etc. about someone on this board you will get a time out. This is pretty much automatic; this behavior can have real world effect and is not acceptable. Obviously the subject is not banned when discussion of it is apropos, e.g. talking about an item in the news for instance. But allegations or references directed at or about another poster is verboten. 2) Outing people - providing real world identifiable information about users on the forums who prefer to remain anonymous. Yes, some of us post with our real names - not a problem to use them. However many do NOT, and if you find out someone's name keep it to yourself, first or last. This also goes for other identifying information too - employer information etc. You don't need too many pieces of data to figure out who someone really is these days. Depending on severity you might get anything from a scolding to a suspension - so don't do it. I know it can be confusing sometimes for newcomers, as SA has been around almost twenty years and there are some people that throw their real names around and their current Display Name may not match the name they have out in the public. But if in doubt, you don't want to accidentally out some one so use caution, even if it's a personal friend of yours in real life. 3) Posting While Suspended - If you've earned a timeout (these are fairly rare and hard to get), please observe the suspension. If you create a new account (a "Sock Puppet") and return to the forums to post with it before your suspension is up you WILL get more time added to your original suspension and lose your Socks. This behavior may result a permanent ban, since it shows you have zero respect for the few rules we have and the moderating team that is tasked with supporting them. Check the Terms of Service you agreed to; they apply to the individual agreeing, not the account you created, so don't try to Sea Lawyer us if you get caught. Just don't do it. Those are the three that will almost certainly get you into some trouble. IF YOU SEE SOMEONE DO ONE OF THESE THINGS, please do the following: Refrain from quoting the offending text, it makes the thread cleanup a pain in the rear Press the Report button; it is by far the best way to notify Admins as we will get e-mails. Calling out for Admins in the middle of threads, sending us PM's, etc. - there is no guarantee we will get those in a timely fashion. There are multiple Moderators in multiple time zones around the world, and anyone one of us can handle the Report and all of us will be notified about it. But if you PM one Mod directly and he's off line, the problem will get dealt with much more slowly. Other behaviors that you might want to think twice before doing include: Intentionally disrupting threads and discussions repeatedly. Off topic/content free trolling in threads to disrupt dialog Stalking users around the forums with the intent to disrupt content and discussion Repeated posting of overly graphic or scatological porn content. There are plenty web sites for you to get your freak on, don't do it here. And a brief note to Newbies... No, we will not ban people or censor them for dropping F-bombs on you, using foul language, etc. so please don't report it when one of our members gives you a greeting you may find shocking. We do our best not to censor content here and playing swearword police is not in our job descriptions. Sailing Anarchy is more like a bar than a classroom, so handle it like you would meeting someone a little coarse - don't look for the teacher. Thanks.

So, all is going well then.

Well, it seems to be going a lot better thna the MSP legal challenge, which missed AC32 and is now well on its way to missing AC33. Unlike the city of SF, MSP has promised lots and delivered nothing.

FBI Seeks Public’s Help in Identifying “The Plaid Bandit” <br style="padding-right: 0px; ">

The FBI and the San Francisco Police Department are seeking the public’s help in identifying a suspect dubbed “The Plaid Bandit,” who is linked to four bank robberies in the San Francisco downtown area.

 

The bandit most recently targeted the East West Bank at the 500 block of Montgomery Street in the Financial District on October 6, 2011. The suspect walked into the bank, brandished a handgun, and verbally demanded money from the teller. The bandit then left the bank on foot with an undisclosed amount of U.S. currency.

 

The suspect is also possibly linked to three other robberies in San Francisco:

 

  • U.S. Bank on July 27, 2010
  • City National Bank on June 21, 2010
  • Bank of the West on June 10, 2010

Witnesses have described the bandit as a white male in his 50s, 5’6” to 5’8” tall, 150 to 160 lbs, with a slim build. He has short white hair and wears tinted eyeglasses. He was also observed with a cane on one occasion and he is known to wear plaid shirts.

 

This investigation is being conducted jointly by FBI San Francisco and the San Francisco Police Department. Anybody with information as to the identity or whereabouts of this suspect is urged to contact the FBI.

 

The FBI can be reached 24 hours a day at 415-553-7400 in the San Francisco area. All calls are confidential.

I am just back from Europe on a trip which included a visit to the Bergen-Belsen concentration camp (just outside Hanover). The Germans are doing a good job preserving the "memory" of such places. When I got there I was more or less alone. But, after lingering in the archives, walking amongst the burial mounds (3000 here, 5000 there, etc etc) and looking at some film, the parking lot had filled with tour buses. For some reason there is a massive German/NATO military base right next to the Bergen-Belsen burial grounds. Tanks zooming around firing guns! In my view, not a happy conjunction of factors.

 

The "Occupy" movement has sprung up while I was away and younger friends are asking for my opinion on what is going on.

 

At the moment it seems like a re-run of the anti-globalisation protests of the last decade.

 

But, because of media, this movement (which started in Wall Street) is spreading fast. Hence, today there are "Occupy" demonstrations in many major cities - in Europe and North America.

 

The primary message seems to be the fact 1% of the population control 40% (or more) of the wealth and this has to change. This is not a new or radical thought. Obama is saying much the same.

 

But my question is this. The "Occupy" movement has reached San Diego. So how about San Francisco?

Is there any chance the AC will be swept along on a platform of disgust with rich people pulling too many strings in too many places.

 

Quite apart from anything else, if I was a youngish anti-globalisation protester in SF I would be closely examining Larry's sweet real estate deal.

 

[PS. After Bergen Belsen I drove through northern Germany - pretty well up to the Danish border. Stayed in pretty ports along the Baltic coast. Did not get over to see Renny because she took off to Almeria. This trip has given me a considerable respect for German attitudes and technology. But also an understanding of why Germans love "wild" places like Canada. The concentration camp - along with the wall and other sites in Berlin - are salutary. But I notice Germany is the one now called upon to avert the Eurozone crisis, bail out Greece etc. On a Swissair flight I saw a film about Ernesto's mates at the EPFL place in Lausanne. With footage of various Alinghi and BOR boats. Don't often see this kind of thing on a commercial flight. At the Hamburg maritime museum I bought a German version of the Ranulf Rayner/Tim Thompson book of AC art. Contains a foreword by Jochem Schumann. In contrast to just about everything else in Germany, the price was right - only 7 euros. Hamburg is an impressive city ]

You cannot go against globalization, but you can hate the 1% bankers that ruined millions of decent US citizens and put the country on its knees.

A protest from a minority is not dangerous, when bourgeoisie joins in, it is a revolution.

Sure the movement will spread to SF as it does in other cities.

And, during a November speech at a high-level meeting in Wellington, I intend to do just that.

 

During the 1980s the radical right in NZ engaged in deep forms of cultural cringe. Compared NZ to Albania, urged young people to regard "the world as their stage". Reject messy colledctivism and look after "Number 1" (Butterworth et al heard and acted on this message). Reject NZ models; find your answers in foreign capitals.

 

Like an old-fashioned colony, authorities imported overseas models. Which did not fit the kiwi context.

 

So, I am advancing the merits of localisation and urging NZ to find answers at home.

And will be pointing at TNZ as an arena for learning.

I plan to defend the $36 mill. public money in TNZ as an investment in brain power. And so get into the "kiwi way" of managing. The $36 mill is not just a tourism matter.

 

Even more than Blake, Grant exemplifies localisation and the kiwi way. Neither excludes open-ness to foreign ideas and people. But requires a critical eye, egalitarianism, plain-talking and having fun.

 

Cabinet ministers will be at the conference table and my plan is to puncture simple-minded (money focussed) notions of globalisation.

 

And bury the idea globalisation is inevitable and beyond challenge.

 

So .... Think local, act local!

If everyone did this, serious global problems (eg. climate change) could be more easily rectified.

ATM, still musing on the close call I had Saturday when I found myself at a traffic light face to face with a black block contingent (yes, a few hundred infiltrated the 100k+ peaceful rally and totally railroaded it, unfortunately) - I mean the SLK is an early model, but still ..

There's a photo on pA3 of my local paper, of a character who looks almost like that, throwing a gas can near the Colosseum, a car in flames behind him. Am guessing that really was a dangerous situation, yikes.

It is an interesting question.

 

His family were in the aluminium roller door (and small boat building) business and their house was often filled with Auckland businessmen with an activist orientation.

 

I suspect Grant was not permitted to use the word "can't" around the family table and his father was quite demanding.

 

GD is a prodigious worker. Has a ferocious work ethic and abhors prevarication and bullshit.

 

But he is a good listener and understands the social dimensions of his projects. Underneath the "let's get it done" personna, is a humane and caring man. He has a well-developed ability to do-the-right-thing (eg. the Pike River ceremony in Dubai, the wreaths dropped off the River Plate etc etc).

 

Sailing around the world helped.

 

But how did he lay the foundations for doing that?

 

Like Dennis, none of these bigtime kiwi Cup campaigners have much in the way of higher education.

None have Ph.D's and there are few Masters degrees. Several - such as Blake and Dalts - have job-oriented credentials from a Technical Institute. Amazingly, GD is a qualified accountant. RC has an Engineering degree but only got it because of the kindness of the Dean who overlooked skipping classes for the purpose of sailing. TS is the most "academic" of the lot. But even he managed to drop out of a doctoral program.

 

These self-educated high achieving kiwis exemplify the very best of the New Zealand do-it-yourself + "let's have some fun" ethos. Also, I very much like the way they and other high performers (eg. Peter Jackson, Ed Hillary, Bruce Farr) puncture the pomposity (and self-importance) of higher education.

I suspect Grant was not permitted to use the word "can't" around the family table and his father was quite demanding.

 

GD is a prodigious worker. Has a ferocious work ethic and abhors prevarication and bullshit.

 

But he is a good listener and understands the social dimensions of his projects. Underneath the "let's get it done" personna, is a humane and caring man. He has a well-developed ability to do-the-right-thing (eg. the Pike River ceremony in Dubai, the wreaths dropped off the River Plate etc etc).

 

Sailing around the world helped.

 

But how did he lay the foundations for doing that?

 

Like Dennis, none of these bigtime kiwi Cup campaigners have much in the way of higher education.

None have Ph.D's and there are few Masters degrees. Several - such as Blake and Dalts - have job-oriented credentials from a Technical Institute. Amazingly, GD is a qualified accountant. RC has an Engineering degree but only got it because of the kindness of the Dean who overlooked skipping classes for the purpose of sailing. TS is the most "academic" of the lot. But even he managed to drop out of a doctoral program.

 

These self-educated high achieving kiwis exemplify the very best of the New Zealand do-it-yourself + "let's have some fun" ethos. Also, I very much like the way they and other high performers (eg. Peter Jackson, Ed Hillary, Bruce Farr) puncture the pomposity (and self-importance) of higher education.

Abu Dhabi has teamed up with the Volvo Ocean Race to bring its 'Keep The Oceans Clean' initiative to the emirate's Corniche 'Destination Village' this New Year, as part of the fortnight-long hosting of the round-the-world race, known as the 'Everest of Sailing'.

'Keep The Oceans Clean', a global campaign that encourages action against ocean pollution threatening sea-life, will involve a series of free community art projects which will run in the 'Destination Village' from December 31 - January 14 next year.

 

Central to the initiative is Skeleton Sea's Albatross Exhibitionist - an imposing 5'5" sculpture created from rubbish washed up on beaches as well as a six minute film that tells the compelling story of the thousands of albatross killed each year by mistaking rubbish for food. Both will be housed in the 'Keep the Oceans Clean' dome, which will follow the route of the 39,000 nautical mile ocean race.

 

Skeleton Sea's founding artists João Parrinha of Portugal, Spain's Luis de Dios and Xandi Kreuzeder from Germany - three 'creative surfers' who started the initiative in 2005 to raise environmental awareness through their green art - will also have a presence at the Abu Dhabi stopover.

 

During the fortnight, the artists will create a unique Abu Dhabi sculpture at the race's Destination Village. Made from beach trash and debris, it will be developed with the help of local school children and the general public during interactive workshops.

 

As part of the wider school initiative being developed by Abu Dhabi Tourism Authority (ADTA), which is behind the emirate's hosting of the race, a series of beach clean-up activities will be staged in the build-up to the stopover, with a key emphasis on engaging and educating children on environmental issues and responsible living. The rubbish collected will be used to help build the Abu Dhabi Skeleton Sea sculpture.

 

Xandi Kreuzeder is hopeful that Skeleton Sea, the Volvo Ocean Race and Abu Dhabi can inspire others to help keep the oceans clean.

 

"It's more important than ever for people to do their bit to protect the environment, even if it means picking up bits of rubbish at their local beach," he said. "If our message gets through to just a few people, then we believe it's been worth all the effort."

 

The 'Keep The Oceans Clean' activities join a growing list of family entertainment programmes being progressed for the free-to-attend Volvo Ocean Race stopover.

 

ADTA has committed to a fully-packed entertainment programme, including exhibitions, shows, simulators, hospitality, game zones, restaurants and cafes, sailing academies, shops and concerts.

 

Volvo Ocean Race is also bringing its 'Life at the Extreme' activity centre. Running daily at the purpose-built Destination Village, 'Life at the Extreme' includes rides and entertainment that allow fans to experience first-hand this 'Everest of Sailing'.

 

Top attractions coming include The Ride, a state-of-the-art simulator that gives the feeling of being onboard a Volvo Open 70 yacht at speed in extreme conditions whilst being bombarded by strong winds and spray; The Dome, a 40 person interactive 3D cinema; The Grinding Challenge, where you can pit your strength against your friends on the pedestal grinders which the crews use onboard Volvo Open 70s; and Air Balls, which gives kids the chance to 'run' on water.

 

Abu Dhabi's Destination Village - as big as eight football pitches and free to the public - will be the focal point for the UAE capital as it welcomes the procession of awe-inspiring racing yachts, sea hardened sailors and more than 100,000 fans for the third leg stopover of the gruelling round-the-world Volvo Ocean Race.

 

ADTA is working closely with a number of governmental and commercial bodies to successfully stage the Middle East's first hosting of the Volvo Ocean Race, including Abu Dhabi Sailing & Yacht Club, the Official Host Yacht Club and key partner in the roll-out of the stopover and the junior sailing initiatives; and the Abu Dhabi International Marine Sports Club, the Technical Headquarters, which will be home to the team areas, media centre, photographer centre and the international television broadcast compound.

You can of course cultivate your qualities, nicely hidden in your antipodean isolation, but chances are bigger that you'll get them to an even higher level after a good looksee around. If it would be my call I would make it a rule that all youngsters get to have a gap year in which they are ordered to go and travel around.Get thee gone and don't come back if you haven't filled half of your passport with weird stamps.

I agree with most of the above. Particularly about young people hitting the road with a pack and passport. Same applies to older people too!

 

I agree small countries share certain attributes. And when NZ told the Yanks what to do with their nuclear weapons and ships, Washington worried about the "NZ disease" spreading to other small places (like Denmark or Singapore).

 

But, in the case of Aotearoa, European immigrants landing there were not a cross-section of UK society. While Australia got the criminals we got innovators, adventurers and the strong-willed. Does this sound like Dalton?

 

In my case I have done quite a bit of work on the immigrant experience and am convinced it still shapes daily life in Aotearoa. When things went wrong in colonial NZ there was no point in waiting for the Agent-General from mother England. Someone on the ground had to deal with the problem. So there was a strong need to work together and derive local solutions.

 

This led to a rejection of British notions of social class. Instead, kiwis consider jack as good as his master. Moreover, much pakeha (white) NZ humour and many attitudes are derived from Maori (Grant has a lot of this). Increasingly, it is the Maori dimension which distinguishes Aotearoa from other small countries.

 

The far-right "reforms" of the 1980s shook the foundations of NZ society. But there are still high levels of creativity and innovation - often seen in the arts, film, food production or yacht-racing.

 

I was in Germany last week and many of the same attributes are visible there. But, in NZ, there is an additional requirement. This project had better be fun. If it ain't fun, why are we doing it? [although this does not apply to those dealing with the Rena oil spill - none of whom are amused by what is happening].

 

It is a challenge to say what distingushes a "kiwi" from any other way of sorting out problems. And it is often necessary to leave the homeland to identify what distiguishes it from other places. But it is not appropriate to sit in a foreign country and fire grenades at those back home. This is why Butterworth is a prick and Coutts deserves credit for dropping the AC45 project into Warkworth.

15 to enter sailing hall of fame

SAN DIEGO -- Dennis Conner, Ted Turner and the late Harold Vanderbilt are among a boatload of America's Cup stalwarts in the inaugural class of the National Sailing Hall of Fame, which also includes the first man to sail alone around the world and the Southern California surfer-turned-sailor who designed the quintessential Hobie Cat.

 

The 14 men and one woman will be inducted Sunday at the San Diego Yacht Club. Of the 15, 11 had a hand in 17 straight America's Cup victories from 1893-1980, and three more from 1987-1992.

 

Others in the group who won the America's Cup as a skipper, crewman or naval architect are the late Capt. Charlie Barr, the late Capt. Nathanael G. Herreshoff, Ted Hood, Gary Jobson, Buddy Melges, the late Emil "Bus" Mosbacher Jr. and the late Olin Stephens. Lowell North, founder of North Sails, made sails for several Cup boats over the decades.

 

Another inductee, Paul Cayard, has extensive America's Cup experience, won the Whitbread Round the World Race in 1998 and sailed in the 2004 Olympics.

 

The rest of the class includes Betsy Alison of Newport, R.I., the US Sailing Team paralympic coach and five-time Rolex Yachtswoman of the Year; Hobie Alter, whose Hobie Cat catamaran popularized sailing among the masses; and the late Joshua Slocum, who sailed alone around the world in the late 1890s. Slocum disappeared at sea in 1908.

 

Every living inductee is scheduled to attend. The posthumous inductees will be represented by descendants.

 

Jobson, who was Turner's tactician in 1977, has an interesting perspective on the first hall of fame that spans all genres of sailing.

 

"What if you took a boat and you had 15 crew and the crew was everybody on that list; what would it be like aboard that boat?" said Jobson, who's also a broadcaster, author and president of US Sailing. "I think what you'd find is a lot of mutual respect for each other's accomplishments."

 

Conner agreed, noting that while this class is loaded with America's Cup stars, it also recognizes sailors from across the spectrum.

 

"We've had a lot of great sailors and it's very nice to be recognized as one of them," said Conner, who won the America's Cup four times and lost it twice. He also won a bronze medal at the 1976 Olympics as well as numerous world championships.

 

"Certainly the America's Cup is the big light, the shining light in this, but people are being recognized for other achievements," Conner said, mentioning Cayard, Alter and Melges.

 

Melges was co-skipper of 1992 America's Cup winner America3, along with Bill Koch. Melges, of Zenda, Wisc., also has two Olympic medals, including a gold, and has won several world championships.

 

Alter is a popular choice for the hall.

 

"He was an ultimate beach guy who figured something out and got a lot of people on the water," Jobson said. "It was a very unique thing. He's done something no one else has done."

 

Wanting a boat that could be easily launched from the beach, Alter designed the Hobie Cat in the late 1960s.

 

"There are a lot of them around," Alter said. "It was just the kind of thing I wanted, really, living on the beach. After I got it made, my friends liked it and wanted it. It kind of kept growing."

 

The 2013 America's Cup will be sailed in 72-foot catamarans on San Francisco Bay. As a buildup, the America's Cup World Series is being sailed this year and next in 45-foot cats.

 

In 1988, Conner sailed a catamaran to a two-race sweep of New Zealand to defend the America's Cup.

 

Turner set the staid yachting establishment on its stern while successfully defending the America's Cup in 1977. He was nicknamed "Captain Outrageous" and "The Mouth of the South."

 

Turner, who founded CNN and owns the Atlanta Braves, was the last amateur skipper to win the America's Cup.

 

"It was the sport that I participated in myself," Turner said. "It was great winning the World Series in baseball, but I was sitting there in the stands. In sailing, I was out there competing myself. It's a totally different experience and I'm very, very proud and happy to be included."

 

Turner said the America's Cup "was the premier yachting event for over 100 years." He's not quite as sold on it now. "I'm a traditionalist. It's a little too high-tech for me."

 

Barr won three straight America's Cup matches from 1899-1903, when the New York Yacht Club turned back the first three of five straight challenges by tea baron Sir Thomas Lipton. Barr's record of winning nine straight races was matched in 2000 by Russell Coutts of Team New Zealand. In 2003, Coutts ran his mark to a record 14-0.

 

In 1905, Barr set a transatlantic record that stood for 100 years.

Joshua Slocum ... sailed alone around the world in the late 1890s. Slocum disappeared at sea in 1908.

 

Every living inductee is scheduled to attend. The posthumous inductees will be represented by descendants.

 

 

I wonder if a Slocum descendant will appear.

Would be interesting to see who it is.

Sen. Pat Toomey's ploy raises questions

A thorny question arising from U.S. Sen. Pat Toomey's ploy to get waivers for gas tankers (by threatening to kill similar waivers for America's Cup sailboats) is this:

Do 45-foot sailboats from various nations pose the same threats of terrorism or environmental problems as posed by gigantic foreign tankers full of liquefied natural gas sailing in and out of U.S. ports?

 

The seafaring waiver issue boiled down to a rumpus pitting the interests of one batch of millionaires and billionaires against the interests of another batch.

 

The first batch comprises wealthy people who, since 1851, have been challenging each other to sailboat races involving fabulous yachts. The series of races is named after the America, the very first yacht to win the trophy, in a race around the Isle of Wight, off the southern coast of England.

 

The America's Cup and associated races are held in various parts of the world. The main America's Cup challenge, with big 72-foot yachts, is set for 2013 at San Francisco, but 45-foot catamarans start racing next week at San Diego in the "America's Cup World Series."

 

The second batch comprises robber barons from Texas and neighboring states, who want to get even richer by devastating Pennsylvania's environment with an intensely toxic gas drilling process. They have been given free rein to do that after making huge "political campaign contributions." (Republican Gov. Tom Corbett raked in around $1 million just for himself.)

 

As reported Thursday on The Morning Call's front page, Toomey, a Republican from the Lehigh Valley, was able to get waivers for foreign-flagged gas tankers that will operate out of the Marcus Hook refinery and gas processing complex near Philadelphia. He did that by threatening to throw a monkey wrench into the America's Cup races in San Diego unless the gas industry robber barons are accommodated.

 

Federal laws, the story noted, say international ships cannot sail from one American port to another without a waiver. The requirement also applies to sailboats. "So Toomey threatened to block" a routine bill to allow the sailboat waivers, it was reported, "unless waivers for the natural gas tankers were granted as well." Some congressional Democrats caved in and the tankers will get their waivers.

 

"That is terrific," Toomey was quoted as saying. It is especially terrific for the robber barons, who will be able to pipe their gas to Marcus Hook, load it onto the tankers, and ship it to their plants in Texas without a hassle.

 

I was happy that Toomey will not be sabotaging the America's Cup event next week in San Diego, which is my second hometown. As a boy, I lived a couple of miles from where the main spectator area for those tremendous sailboat races will be.

 

Still, I fretted over Toomey's successful bid to accommodate tankers carrying vast amounts of volatile liquefied gas.

 

Recent federal laws were enacted to deal with threats of terrorism and environmental problems posed by such ships, especially when registered in foreign countries. The original law regulating foreign-flagged ships was in 1920, but more recent measures came in 2008 and 2010.

 

When the later federal laws were enacted, they particularly focused on the dangers of ships carrying liquefied gas. The Coast Guard Authorization Act of 2008 required clearances by the Coast Guard.

 

Now, thanks to Toomey, the gas industry will be able to sail the gas tankers in and out of U.S. ports with no need to get those pesky time-consuming Coast Guard clearances. (Even though many ships are built in America, owners often register them in other countries to dodge U.S. taxes and other requirements.)

 

Toomey said he was motivated by a desire to create as many as 325 to 425 jobs at Marcus Hook. Cynics might wonder if the real motivation was to help make gas industry robber barons wealthier, as long as they keep pouring money into GOP coffers.

 

The thorniest question, however, is this:

 

Which batch of rich people pose the most serious threats to American security — the robber barons with their foreign-flagged tanker ships full of enough liquefied gas to blow up entire cities, or the rich yachtsmen with their 45-foot sailboats?

 

When I submitted that and other related questions to Nachama Soloveichik, Toomey's press spokeswoman, she did not answer directly, but sent an email note saying, "Sen. Toomey was simply seeking a waiver to allow three American-made ships to travel from Pennsylvania to the Gulf Coast for a project that will create hundreds of jobs in Pennsylvania's Delaware County."

But the re-flagging thing is reminiscent of the Intrepid case, it actually seems reasonable to me big-picture-wise.

They know how to win a regatta. Soon, we'll learn if organizers of the 2013 America's Cup also know how to keep legitimate concerns from becoming full-scale controversies.

 

If they don't, a huge project with a rare degree of support in San Francisco could find itself the target of sniping by second-guessers from all sides. The event organizers also could find themselves scrambling for permits as the clock ticks down in a time frame that leaves no room for error.

 

That's why it makes sense to make a few concessions early - such as Cup officials clearly stating that they will not seek to build marinas along the downtown waterfront after the conclusion of the summer-long sailing spectacle.

 

They also should make a prompt effort to work with recreational water users to ensure that access to the bay won't be hindered during the months of preparation leading up to the regatta.

 

"The more quickly organizers take some of the issues off the table, the easier they make it for everybody," says Supervisor David Chiu, who serves on the Bay Conservation and Development Commission. "We support the America's Cup, but we also want to make sure that access to the water is improved for everyone as a result of the event."

 

To their credit, the organizers have dropped one brazen aspect of their plan for the summer of 2013 - the use of the quarter-mile stretch of water between Piers 14 and 22 as a docking area for 26 recreational yachts between 100 and 250 feet long. This would have walled off neighboring Rincon Park so that visiting millionaires could drop anchor and party.

 

The revised plans make room for some yachts along Pier 14 while mooring others along Pier 9 or near Pier 36, preserving Rincon Park's memorable vistas.

 

 

Permanent marinas

What hasn't changed is the wording of the host agreement signed in December by then-Mayor Gavin Newsom and the America's Cup Event Authority. This gives the authority the right to negotiate to build permanent marinas in the two open basins between the Ferry Building and AT&T Park. The right would be triggered if the authority needs to dredge either basin - a certainty, given that the competing teams in the Cup will be based at Pier 32 and in the basin between Piers 32 and 36.

 

That's irrelevant right now, according to city officials who are leading the push to line up the permits and approvals needed for the Cup. But when BCDC commissioners met to discuss the plan on Thursday, the specter of a long-term loss of access colored the discussion.

 

And that's ominous for the Cup, because BCDC has regulatory power over any changes to the current San Francisco waterfront plan - rules that treat the open basins as essential to appreciating the bay from the land.

 

"I would not be willing to compromise that in the long term," Vice Chairwoman Anne Halsted said of the need for open waters south of the Ferry Building.

 

The commission voted unanimously to schedule a Jan. 5 hearing on the request by the city to alter the waterfront plan so that the open basins can temporarily include docks and vessels during the Cup. Every commissioner who spoke, though, stressed his or her opposition to permanent marinas.

 

Several also responded sympathetically to concerns raised by several kayakers, swimmers and board sailors.

 

 

Assurances sought

Each advocate said they want to see the city host the regatta. Each said they don't expect to be allowed in the water on race days. But they want assurances that the waterfront between the Golden Gate Bridge and Mission Bay won't be off-limits in the months before and during the Cup - and so far they haven't heard much.

 

This makes no sense.

 

The America's Cup organizers, who did not return e-mails seeking comment, clearly know how to drive a hard bargain: On the eve of the contract signing in December, there were bellicose threats to sail off instead to Rhode Island. But it's one thing to play tough in one-on-one negotiations, and another to keep your cards close to your vest when residents and regulatory agencies simply want to hear that they won't be blind-sided down the road.

 

"If they (Cup officials) proactively reached across the table, it would go a long way to giving everyone an indication that they see the people of the Bay Area and San Francisco as partners," BCDC senior planner Lindy Lowe said after the hearing.

 

"The way they have worked so far with us and other stakeholders, it hasn't always felt that way."

 

Cup officials need to line up an enormous number of approvals during the next six months so that physical work can begin. The sooner they settle the easy issues, the sooner everything else will fall into line.

Mr. YOUNG of Alaska (for himself and Mr. BRADY of Pennsylvania) introduced the following bill; which was referred to the Committee on Transportation and Infrastructure

 

 

A BILL

To authorize issuance of certificates of documentation authorizing certain vessels to engage in coastwise trade in the carriage of natural gas, and for other purposes.

 

 

  • Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

 

 

SECTION 1. SHORT TITLE.

 

  • This Act may be cited as the `Domestic Energy Independence and Maritime Jobs Creation Act'.

 

 

SEC. 2. VESSEL DOCUMENTATION EXEMPTION.

 

  • (a) In General- Notwithstanding sections 12112 and 12132 and chapter 551 of title 46, United States Code, the Secretary of the department in which the Coast Guard is operating may issue a certificate of documentation with a coastwise endorsement for each of the following vessels:

 

    • (1) LNG GEMINI (United States official number 595752).

 

    • (2) LNG LEO (United States official number 595753).

 

    • (3) LNG VIRGO (United States official number 595755).

 

  • (B) Limitation on Operation- Coastwise trade authorized under subsection (a) shall be limited to carriage of natural gas, as that term is defined in section 3(13) of the Deepwater Port Act of 1974 (33 U.S.C. 1502(13)).

 

  • © Termination of Effectiveness of Endorsements- The coastwise endorsement issued under subsection (a) for a vessel shall expire on the date of the sale of the vessel by the owner of the vessel on the date of enactment of this Act to a person who is not related by ownership or control to such owner.

 

 

SEC. 3. OPERATION OF DRY DOCK IN KETCHIKAN, ALASKA.

 

  • A vessel transported in Dry Dock #2 (State of Alaska registration AIDEA FDD-2) is not merchandise for purposes of section 55102 of title 46, United States Code, if, during such transportation, Dry Dock #2 remains connected by a utility or other connecting line to pierside moorage located in Ketchikan, Alaska.

Herman Cruise Terminal Project. Supplemental Information Package No. 4 has been posted for public review on our website at http://www.swrcb.ca.gov/sanfranciscobay/public_notices/. It includes the stormwater control plan approaches for the America's Cup Event project component and the James T. Herman Cruise Terminal Component as well as a letter from the San Francisco Public Utilities Commission discussing the adequacy of the stormwater control plan for the James T. A new project at the Marcus Hook refinery in Delaware County has been held up because there are no qualified U.S. flag liquefied natural gas tankers available to transport natural gas from Delaware County in Pennsylvania to the Gulf region.<br style="font-family: Verdana, Arial, Helvetica, sans-serif; "><br style="font-family: Verdana, Arial, Helvetica, sans-serif; ">Granting these waivers will create significant new jobs in the Pennsylvania region. It will result in 300 to 400 new construction jobs to build the necessary facilities in Marcus Hook and 25 long-term, full-time jobs to maintain the facilities. New construction jobs will also be needed in Washington and Westmoreland counties where a new pipeline will be built to connect to existing infrastructure. In addition, these ships have the potential to be serviced and maintained at the shipyard in Philadelphia, further bolstering Pennsylvania's economy.<br style="font-family: Verdana, Arial, Helvetica, sans-serif; "><br style="font-family: Verdana, Arial, Helvetica, sans-serif; ">The House and Senate-passed bill contains the waivers needed to get the Marcus Hook project off the ground. The House approved it by unanimous consent today; the Senate approved it by unanimous consent Thursday.<br style="font-family: Verdana, Arial, Helvetica, sans-serif; "><br style="font-family: Verdana, Arial, Helvetica, sans-serif; ">"This is a victory for jobs over government red tape, and it will help workers in our region who are facing tough times," Rep. Meehan said.

"By cutting through the red tape and putting Pennsylvania workers before foreign yacht owners, this new law will help create good energy and construction jobs in our region."

Big article in the Chron this weekend about abandoning the effort to preserve purely native ecosystems in exchange for maximizing healthful collaborative ecosystems. I expect this includes disallowing and ameliorating the claims of certain so-called "natives" in favor of supporting the defacto status quo. After all, if "Native American" claims are to be considered, then pre- "Native American" environments need to be granted prior claim.
