a.) There is proof that Trump paid Cohen back for the NDA. There is no proof Trump knew about the contract beforehand, which would mean he could not have been a party to it, and without all parties knowingly entering the contract - it can be judged as invalid. Trump will need to say, on the record, he knew about the contract at the time for that legal argument to lose it's power. In other words, Trump needs to admit in a sworn document the public can access that he lied about the entire thing from the start and that when he called her a liar it was a knowingly false statement. Better to let the NDA slide and keep plausible deniability against a defamation suit. 

b.) He didn't open that guy up to criminal charges. The SDNY employee opened himself up to those charges and has outlined the reasons for it being nothing to do with Avenatti.

Yup...this time.  With the volume of stuff they took from him, and the lack of privileged material therein, they either have the goods on New York's Most Competent Attorney at this point or they don't.  What is she going to give them, other than a chance to ring him up for applying the same flexibility with the truth that  characterizes seemingly every other person in that crew who has been interviewed?  If they feel the need to jam him up with an obstruction charge (which he may already face, given the shredding, and whatever they used for probable cause for the search warrant of an attorney) and a perjury charge if he's been talking to them, they can reschedule with her...quietly.

I agree - sdny wants to prosecute the case in court, and avenatti only wants publicity.  hence his leak to the press about the meeting.

ms daniels place in sdny's bank fraud / election finance case is small, and thanks to her attorney, all ready public

the real evidence is in the material delivered by Mueller and gathered by sdny

The real questions  did he likely have an associate take the fall for  impregnating a women.  Why did that person pay $1.6m through Michael Cohen using the same NDA as stormy Daniel and what did that associate get for falling on the sword.

That’s it, spot on. This is about avoiding the deposition. So focus on the cases in which he is a defendant, like Stormy’s defamation case against him.  He can’t dismiss those and run away to rub his bone.
