John Roberts sides with liberals on Supreme Court to block controversial Louisiana abortion law

Excellent.  Well done JR!  I admire his principles that precedent was more important than his personal opinion.

A person of principle.

Four years ago, the chief justice was among the dissenters when the court struck down a Texas law that required doctors performing clinic abortions to have admitting privileges at a nearby hospital. But on Monday, Roberts joined the court's liberals in striking down a nearly identical law in Louisiana, even as he stood by the reasoning in his earlier dissent.

The chief justice justified the change in his vote by pointing to the doctrine of stare decisis, which says the court should usually stand by its precedents. It "instructs us to treat like cases alike," he wrote, and "the Louisiana law burdens women seeking previability abortions to the same extent as the Texas law" did four years ago.

Almost worse than "patriotism" as the last refuge of a scoundrel.

The Reichista US courts don't give a rat about SD unless it is convenient as a justification for how the oligarchy wants them to vote.

In this context, your comment makes no sense.

My point was that for abortion rights, or any other decisions the modern SCOTUS makes the

conservative justices only use stare decisis when convenient - otherwise they ignore it all the time.

If they really accepted stare decisis, then Roe V. Wade would be settled law.

Sorry I was not more clear.

And Plessy v. Ferguson would still be the law of the land.

How far are you willing to defend stare decisis?

This case affirmed the "right" of abortion clinics to hire radiologists to do abortions. Gotta keep those costs as low as possible.

All justices

Roberts wanted to overturn but he knew his party would never recover if you added millions of women protestors (that would be in the streets from now until the election) to the millions of BLM protestors during the pandemic.  Roberts may be a piece of shit federalist asshole sky fairy worshipper but he wants to see 25 years of full democrat rule even less than he wants to see legal abortions in Louisiana

BS!  If he was that big of a party hack, he would have overturned obamacare when he had the chance and voted against the LGBTQ case last week.  Your biases are showing again.  Time to go change your undies.

Huh? You might want to give that a reread and try again as both of those actions would sink the already foundering GOP.

Radiologists make a shit load of money.  Right up there with cardiologists.  That a shitty way to make a  profit.

Do you think they care?  Why else would Mitch be so adamant about loading the court up?  They want abortion gone, gays gone, and obamacare gone no matter how much you and I know it will hurt them in the long run.  Why do you think the GOP was so furious with Roberts in the LGBT workplace case??

If what you say is true, and its about saving the GOP from themselves - then Alito and Thomas would be falling all over themselves to vote with the popular opinion in those cases to save the GOP.  No, instead they will go to their grave to burn it down because a crispy GOP is still better than trannies and socialistical healthcare.

Just to help out I will quote the last bit

Forest meet trees, Cleans point is winning elections and the whoosh is the point going over your head. I have no idea where the rest of your rant is going.

Nothing went over my head.  You both are just simply wrong.  I don't think Roberts is doing anything to ensure GOP election wins.  First of all, why would he care?  He has no skin in that game anymore, being the Chief Justice of the SC for life.  In fact, I think quite the opposite.  I suspect he is disgusted with the current GOP, as many of us are, and sees them being complete and utter traitors to the values of conservatism.  I think he has always voted his conscience and what he feels is the right thing to do, no matter which "side" of the issue he falls on.

That you and clean think JR is doing it for purely political motives and has no honorable reasons whatsoever, then I am saddened to have to call you my countrymen.  That mindset is precisely what I've been opining about lately, that everything is seen through a partisan filter these days and that mindset that everything is evil unless it's your elk doing it will ultimately tear this country apart.  Seriously, fuck you and your rented mule (named clean) you rode in on!

Feeling is mutual.  I am grateful he took that position but one vote doesn't make him a hero.

edit: Isn't there some way to bring in the 2A here? You did a heckofa job in the BLM thread.

Meh.  Like he gives a flying fuck what you think of him.  And it hasn't been just one vote, dipshit.

Alito and Thomas have gotten more and more zealous in their old ages.  Roberts is a loyalist to the GOP of yesteryear.

I could point out that Brad Man attributed Cleans opinion of Roberts to me when I pointed out that the vote would have been a death knell for the GOP as would the other two examples he brought up. I think Roberts is the better of the Republican appointees and that to think he isn't aware of what a number of years of Democrats in power will do? At present he is the swing vote. Good place to be and may well change in the near future and for a long time. Anyone that believes he doesn't care what the makeup of the court is naive.

I could point those things out but it won't make any difference.

Roberts also knows that a unified democratic government gonna make him a minority on the court pretty quickly.

True.  I also believe that he is a loyalist to the history of precedent and the dignity of the court.  (I hope Dred Scott excepted.)

Nancy traded congress for Obama care, and said she’d do it again.

as much as I hate it, Mitch is going to trade congress for 200 federal judges. And I bet he’d do it again. If the senate goes Democratic he’s gonna do 2 years, retire and claim victory. Sadly, he’ll be correct.

Well, yeah,. but only so long as they have their own, taxpayer-funded, gold plated health care.

I think it's pretty plain for all to see that it's both completely accurate and total bullshit.  Think of anything that's not 7-2 or better as a split decision, just like in a fight.  When there is a split decision in a fight, there's only one thing that's certain: There was no clear winner.  Sure, a guy may have been robbed a little, but almost invariably there is just no clear winner.  That's how those SCOTUS decisions are.

Out of my experience but it seems to me that Roberts is a pretty decent chap even if he is a republican. You should be grateful.

FWIW..I think your SC appointment process and tenure is pretty stupid. I'm amazed it works at all.

Supreme Court Declares Another Abortion Law Unconstitutional

Quote

The U.S. Supreme Court has handed another blow to backhanded attempts at abolishing abortion by making clinics comply with ridiculous and unnecessary regulations.

I'm as sorry as usual about posting more Koch-$pon$ored TeamR cheerleading.

The major sacrament of the (D) party can't be held to any standard.

Most of those doctors in the case had held admitting privileges in the past, but magically couldn't get them for purposes of their case (not that they even tried). Imagine that.
