Correct, David Boies is who represented ETNZ in the anti-trust case that they later dropped.

 

Apparently GGYC has now employed him too. You might think this statement will put to rest any ideas that the issues with SNG have been settled, because Boies is big-time!

I made the same comment before (here) and MM (of course) said that SNG were the richest club in the world, blah, blah, blah. I'll say it again, if I were a SNG member, I would sure as hell be asking what sort of D&O insurance and what sort of liability insurance we had and what sort of indemnity agreement there is between Alinghi and SNG.

This is awesome news for the issues coming down the road that have been talked about in the SAAC. Also, potential for another legal avenue mabye at the Federal level.

 

I expect JK to be around as there is too much AC history & NYSC background with Judge K at the NYSC level. I look a Boies coming onboard to expand the GGYC legal team & to take the issues coming down the road to a different level. He's an anti-trust specialist at the top.

 

TE was pretty specific on Boies mandate being "to protect our competitive interests, the interests of sailing, and of the Cup itself" MSP might be right about this going Federal. Looking at Boies background he is overkill for the state level.

 

I'm guessing that we will see Boies entrance into the battle maybe end of next week or first of the following week as the clock is ticking on getting any sort of Mutual Consent on RAK & etc. Maybe this big gun will force SNG to wake up & start thinking about being sporting & looking at Mutual Consent as this as gone too deep than any other AC already.

I have been assuming that both the venue choice and powered systems decision will both be going back to court soon, with BMW having a significant likelihood of prevailing on both issues. Boies appearance indicates that this is accurate, and that BMW's likelihood of prevailing just went up even more.

I would infer that communications with SNG/alinghi if any have made no satisfactory progress to date as far as GGYC is concerned since the last court session.

A couple of things,

 

First, for those Anarchists out of the country, think the Ronaldo of attorneys. (or Becks before he got involved with spice girls!)

 

Second, SNG had better have a come to Jesus meeting, Boies doesn't usually take on cases he doesn't think he can win. Furthermore, when this guy gets involved the gloves come off, he's a tactical pit bull. I would love to have been in those first few meetings with Boies, TE, Ellison and the current GGYC legal team. You can bet your ass that Boies's team will be calling ALL of the legal shots from this point forward.

 

Finally, don't bet on a race in February or at all for that matter. SNG had the chance to settle this on the water, but instead they decided to push the envelop at every single turn. So now, uncle Larry is finally tired of the bullshit and has hired the Babe Ruth of attorneys. Good luck Ernie, see your ass in Federal Court.

 

If he's smart, EB will pick up the phone tonight and give Larry a call. Time to mediate, asap.

If the judge sides with BMWO, doesn't that mean that Alinghi were breaking the rules? Now if BMWO go to court and lose, it means they are whiners. But if Alinghi lose, they are cheaters... right?

Simon... You can't be serious. I know you can use logic. How can there be a victory on the water if there are not rules? So yes, if there are no declared rules, the only reasonable course of action is to try to win in court (where there are rules, albeit, not perfectly clear ones - but better than none)

David Boies is arguably the best litigator in the United States. The GGYC letter is clearly a shot across the bow of SNG and a sign that GGYC will not back down in protecting their rights and enforcing the Deed of Gift. In poker terms it's as if Larry looked Ernesto straight into the eyes and raised a whole bunch!

The Grand Challenge Cup at Henley Royal Regatta has been continuously contested since 1839 - with a couple of pauses for world wars (relatively minor gaps compared to the hiatuses in the AC). They've only had to replace the cup once.

 

The AC is the oldest trophy in international sport.

I don't think anyone will ever worry about losing on the water, if rules are fair and just. It will be absurd have a race with one sided rules.

 

Both parties are pushing eachother to the extent they can. By engaging Boies, BMWO are just conveying that they would not take anything lying down.

  1. If you watch the BOR press conference video, you will see that Ellison was genuinely annoyed by SNGs "bending" (and concealment) of the rules. He thinks he's got a boat fast enough to win, but he's afraid SNG will do anything to keep them from winning, and that includes making up rules as they go along to stop GGYC from winning.
     
  2. Ehman's flat statement that the SNG measurement rules will disqualify USA if they are enforced as written tells me there hasn't been any progress on this front. Marian, is SNG going to use rules to disqualify or cripple the GGYC yacht, while they bend the rules to give an advantage to their yacht (powered systems, movable ballast, etc)? How is this "winning on the water"?
     
  3. The example of SDYC publishing the rules only weeks before the race is not a precedent setting example for SNG's bad behavior. Except for racing the catamaran (which I think was disgraceful), SDYC did nothing with the rules to disadvantage the challenger. That certainly doesn't seem to be the case this time.

I hope that in bringing a new round to the courts the case will be fully researched and extremely well presented. But what are you looking for in bringing it a federal court? But in a joking post on another thread was the press release dated 2027. This may not be too far from the truth these days.

Some of you really don't understand. Some of you think this is all about "fairness". That is simply wrong. This is all about LE's inability to win the Cup, at any cost. LE is used to getting his own way by spending money. He buys whatever he wants. However, so far, he has tried 2 "normal" campaigns and spent more than any other team in those campaigns. For this AC, he was, yet again, prepared to outspend everybody, offering record pay and allotting record budgets. Now he discovers that the DOG gives all the advantages to the defender and that the challenger is left high and dry. I personally think that was deliberate in the DOG, to force some mutual consent. Therefore, having failed in the court to remove the advantage that the DOG gives the defender, it looks like he is going to try to get the defender DSQ'ed without sailing.

 

And all the time, you think this guy is sporting and about fairness. What most are unable to see is that LE is just as bad as EB.

 

Having said that, let's see what actions BOR take. If they simply appeal the location and rules issues, fine. All's fair in this war regarding that. But let's get the court to agree what the rules are (or aren't) and get the thing on the water. If the DOG is written to give the defender an advantage, so be it. Sort the rules and then sail. LE made a DOG challenge and needs to sail it as a DOG challenge, whatever that is and he needs to take a leaf out of GD's book and HTFU!

I'm sorry but the last however many months of litigious b.s. are the result of a brazen attempt by EB to rig the event. LE and Oracle would have been perfectly happy to compete in a challenger series if one that was appropriate had been brought to the table by a viable challenger, which CNEV as we now know obviously wasn't. In one respect I am quite surprised given the obvious collusion and ethically bankrupt CNEV approach that a challenge to suitability as trustee was not immediately forthcoming from multiple avenues.

 

That said, what is lost in all of this background noise is the idea of a sportsman like challenge. Notwithstanding the history of the NYYC and the SD debacle, at some point you have to say enough is enough and consider that someone needs to take the high road.

 

Why EB chose to take the low road is anyone's guess; hubris, arrogance, warped vision, whatever. What should make people angry is not the tedious back and forth of this last couple of years, but rather the root cause. The question that needs to be asked, in order for the AC to return to any type of relevance or dignity, is when is there going to be a trustee that truly embraces the intent of the Deed?

 

Romantic naivete on my part? perhaps. But seriously, to assert that SNG/EB has the high ground at this point from an ethical or competitive perspective is ludicrous. We wouldn't be here were it not for the asinine protocol coming out of the CNEV affair, it's that simple.

SimonN, while you are correct about the fact that LE has yet to win the AC on the water, you are far from correct about the reasons that this went to court. You can be an Alinghi fan and supporter and I say more power to you. As far as the reason that this went to court in the first place, it is the CNEV challenge and the protocol that followed. I do not like it being in court and think that at one point LE and crew had an opportunity to sit down and negotiate a reasonable outcome. Since that time is long gone and Alinghi is pulling every punch that they can to shove it up LE's ass as far as they can, I would go back to court as well.

I kept reading that release expecting the breach of trust paragraph.

 

I said before and will say again - SNG was allowed in by mutual consent - they are not a deed legal entity. Sham regattas in the med don't cut it and there was no mechanism to remove the cup from them except on the water or via a breach suit once they had it. Once they lose or are stripped of the cup they are done for good as an AC player....

 

They had visions of F1 in their Alinghi eyes and not on running a simple regatta - LE was pretty much the only current player with the balls and wallet to call them on it. Yes Alinghi cooked up all sorts of pseudo legal crap (CNEV) and put out lots of "lets all play nice together" pr, but the truth is their eyes were on something bigger - the F1 style AC, and they really did have to back pedal and delay to meet and catch up to GGYC once they were called to task. They are still playing games as they know GGYC has the upper hand with time on the water and are doing everything possible to not actually have a damn yacht race - fucking with venue, rules and anything else that will keep them in the game cuz like I been sayin - once they are out - they are gone for good....

 

I hope GGYC do launch a breach case - I think they have enough ammo to prevail. Should be interesting to see what happens either way....

 

Simon and the other on the SNG/Slingh love train - seriously, do you really think SNG, a Swiss lake club, and their member peeps think their annual regatta(s) is/are on the ocean..?? Come on - sure they had some as a legal workaround but seriously, in plain common sense terms would the fine folks of SNG really consider that their normal regatta site..?? That is where the bullshit all began - not with LE and GGYC/BOR.

This latest epistle from BMWO is an inelegant blunt declaration in their best George Bush style that all options are still on the table. It was always on the cards that Larry was going to get a quicker gunslinger so David Boies was always in the frame. I would suggest that the Boies-advocated ETNZ anti-trust action against Alinghi and the associated details would not be entirely breaking news to the BMWO camp.

 

It's also a shot across the wake of Judge Judy's protracted deliberations which really should have been concluded by now: she can't be delving into things which have no direct bearing on the issues she has to render a decision on, surely!?!?

You guys always forget that le was willing to sign off on cnev, one boat teams and defender in the challenger series at one point, then his renta management te/rc talked him off of that cliff.

 

They are both ego bils and neither give a shit about your ideals of the America's Cup.. they are willing to fuck with each other and spend what ever it takes to possess it.

 

The judge needs to strip them of their ego stroker advisors and their fuck off lawyer teams and make them sit in a room together until they come up a set of rules and a venue, and then go race their fuck off boats on a dog course and make this shit fight be over.

Right, and Larry/GGYC/BOR quite happily agreed with the Arbitration Panel that SNG were eligible and even jumped into bed with them as Challenger of Record for AC32.

 

Larry and Ernie had a joint vision for how the AC should be run in future. Larry thought that between them they would continue that vision but Ernie dumped him in favour of CNEV. This is personal and has nothing to do with the AC. Larry is quite prepared to drag the AC, ISAF and anyone else who gets in his way through the mire just to get back at Ernie and enforce his own vision for the AC. Ehman is just hanging on Larry's coat tails in the hope that he will get the job of running Larrys 'indpendent' Americas Cup Management Company. Coutt's just wants to get back at Ernie for not letting him sail for another team in AC32. BMWO is run by bitter, twisted men who all have their own agenda's. BMWO will implode before this all over and we are seeing the start of it already. Remember when SNG changed lawyers and all the jokes and derogatory comments made in this forum? Well the joke is now on GGYC.

 

This is not about CNEV or anything that happened after that. That was all done and dusted in April. This is is about BMWO not accepting that the Defender has all the rights in a DoG match. They will find it hard to argue against the MB CoA ruling, the April CoA ruling and JK's ruling all which say the same thing. The Defender can pretty much do what they like to uphold their Fiduciary Duty which is to defend the AC against the beneficiary, the Challenger.

 

I don't even know why they are doing this. It achieves nothing. They can't get their hands on the Cup without actually sailing for it. SNG could quite conceivably say fuck you and hand the Cup back to RNZYS along with a Challenge. Then BMWO are back at square one and having to race a bunch of other boats just for the chance to challenge again and we know how successful they have been at that. :lol::lol:
