It was a cold and foggy night and only a fishing boat and Privateer were out on Cape Cod. One was fishing; the other, it was going from halifax to Newport.

Things that go bump in the night.......

 

All crew safe- nobody hurt.

Was either boats making the required sound signals for reduced visibility as outlined in the COLREGs?  How many crew aboard Privateer for the trip home?

(not trying to assign blame, just curious)

Glad to hear you and all the crew are alright Soley. There are lots of ways this could have been a different story in a bad way.

That is a hellva split in the hull. You must have had to nurse her back to Newport.

Lights? Radar? Sound Signals? What went wrong?
Edit: Understand if you can't comment due to any legal issue. (but like nauti, curious how a fishing vessel with radar ploughs into a sailboat like that).Main thing is that you are okay.

We did what we could, to sail in a prudent manor, unfortunately we dont believe any one was in the wheel house of the fishing boat. They guy on watch saw a guy of the bow of the fishing boat run into the wheel house just before the collision. He didnt see anyone else in the wheelhouse..

Bumch of years ago a brand new J24 was racing one of our PHRF weekend series. Boat got hit by a fishing tug(google great lakes fishing tugs) as the sailors were jumping port and starboard into the water. Gouge nearly to the cockpit footwell. Two on board the tug were probably cleaming or sorting catch. 7-9 witness boats for that one.

If the fishing vessel was engaged in fishing with the proper navigation signals and lights displayed, they have right of way over more maneuverable sailing vessels, even if they are sailing. (No this is not an exact reproduction of Colregs, but you get the idea)

Sailing does not give you rights over all non-sailing vessels.

Dude you obviously dont know much about dealing with insurance companies, the coast guard or lawyers regarding a marine incident. The truth is out there, but doesn't necessarily need to be made public for all to see yet....so STFU you "dishonest asshole"

Seems to me that a working fishing boat has ROW over pleasure boat under sail?  I always stayed away from the fackers, no matter how many course changes they made to run me down......

 

And most race boat BN's on deliveries only sail if the wind is ideal and they have enough hands.  It's a job, not a holiday; and usually a power boat ride, and often single or short-handed.  Used to leave at 3 AM for the tide to motor from Newport to Stamford in 12 hours.

Geezus H. Kjrist. Fishing Vessels that have nets, lines or dredges down and are displaying inverted cones and/or all-round green over white lights have the right of way over all other vessels except those who are restricted in maneuverability and vessels not under command.

AFAIK there is no requirement for <300 ton vessels to have AIS.

AIS is a wonderful thing....I'm assuming of course the fishing boat had a transponder turned on and didn't do a radical course change at the last minute...

Well aware of BN delivery practices, been there and done it.

Both boats steaming, pass port to port.

Fishing got gear down or getting up, as you say, stay the fuck out of the way. Doesn't matter if you're under sail or not.

Please refer to COLREG's Navigation Rules. Section 3, Conduct in Restricted Visibility (Rule 19).

There is no stand on or give way vessel when operating in restricted visibility. Both vessels are obligated to determine if "...risk of collision exists. If so she SHALL take avoiding action in ample time..." It looks like a fairly square T-bone, avoiding action was not taken in ample time by either vessel.

 

Basically it sounds like both vessels screwed the pooch on this one. Degrees of fault will very, but that is up to the lawyers to figure out.

 

Sad day, I'm glad everyone is OK.

How about more than  15,000  *25,000 miles delivering race boats, and other type boats since 1970?  Often in reduced visibility, with fishing boats all around...  Were you wearing nappies, or short pants, in 1970, Mr. Clean?  :D  :P

 

BTW, I am hoping that Madison Beach Club will come up with your 700 words and some pics of the Atlantic class Nationals; that you promised to put on the front page.  I will keep you posted.

 

* edit - I forgot about Bermuda to Hawaill on the Frers 80 in '82 and FLL to Azores in '79 on the Golfcart 50 that nearly foundered in a hurricane...
