You are making the presumption that the only thing that matters is the protocol and CAS procedures.  Could it be there is more to this than you know?

The only thing that hung Dirk was Bryce saying he thinks he remembers Andy saying something that Dirk was really interested in getting weight forward.  

Another fabrication. Read the CAS ruling. It clearly sates that Bryce said he was instructed by DdR and it also states that while initially denying it, Walker later agrees that DdR gave the order, which is exactly what he told the IJ. Therefore, there are 2 people who say the same thing first hand 

 

Nowhere in any evidence does it even suggest that Bryce says "he thinks he remembers Andy saying something...."

 

For somebody so hung up on trying to get to the truth, you don't seem to apply the same standards to yourself. You seem totally content in changing facts to suit your case.

 

You know what's interesting, reading the transcripts of the hearings from August '13.

Point 60 of the CAS report kills Coutts' "ridiculous mistake" stone cold dead. Ruthenberg told Coutts early in the investigation that he'd added weight, that he knew it was illegal and that he'd therefore hidden it from the measurers. Not a "mistake".

 
 
You moron, Bryce made a mistake by adding the lead, then he compounded it by not asking anyone or talking to anyone about it.

 

As usual, when you can't respond to the issue you resort to abuse.

What's deliberate is not a mistake. Ruthenberg has said he knew adding the lead was illegal and he did it anyway. No "mistake".

As for "not asking anyone", that wasn't his testimony. CAS clearly believes him, because he has been consistent and has no incentive to have said what he said. He certainly would have been better off maintaining omerta like most others and because of it his career is dead.

But rather than applauding the one person with the moral courage not to give the IJ the silent treatment, you are calling on us to disbelieve him. DdR's counsel called him a liar (para 119). So do you agree Huston? Do you think Ruthenberg is a liar? Why do you think he gave testimony that ruined his career unless it was to tell the truth?

 

Here's a question:  Was Bryce hired by Team Australia to work on the AC 45 program?

ISAF Statement - 34th America's Cup Jury

On 14 April, ISAF received an appeal from Mr Paul Henderson (CAN) concerning his formal complaint against the members of the International Jury of the 34th America's Cup (Bryan Willis, Graham McKenzie, David Tillett, Josje Hofland and John Doerr). The appeal was against the decision of ISAF not to pursue a disciplinary case against the jury members because there was no case to answer (based on Mr Henderson's complaint).
With the agreement of both parties, the appeal was heard by Dr Dieter Neupert (SUI) and on 31 July 2015 he dismissed the appeal and upheld the decision of ISAF that there was no case to answer.

This decision is final and binding and is not subject to any further appeal.

Nothing very revelatory - we did the best job we could following the procedures laid down and a bit of common sense*, we were stymied by a bunch of arse-covering cheats who we duly fined and penalised, they and their mouth-pieces have slandered and libelled us ever since

Now comes the fratricide and a few revealed secrets....

America's Cup - ISAF and Cup Jury summonsed by California Court
 
The International Sailing Federation, the controlling body for world sailing, and the five individuals who made up the International Jury for the 34th America's Cup have been summonsed by a San Francisco Court. 

The action has been bought by Matthew Mitchell (NZL) a former Oracle Team USA crewman who was one of five to be penalised by the International Jury after conducting and investigation and Hearings into allegations of boat tampering in the America's Cup World Series.

It is also claimed that the Jury had ignored the law of scienter, which requires that an offending party must have knowledge of the 'wrongness' of an act or event prior to committing it.

Mitchell claims that he did not know that the changes to Kingposts and other modifications were illegal. He assumed, because they were on a support team work-list, that they had been approved by the team's rules adviser and were therefore legal. The boats involved were AC45 wingsailed catamarans and were strict one-designs, and could not deviate from the class rules in any way

 

Pathetic. It's a sport. You are supposed to know the rules.
