Correct, David Boies is who represented ETNZ in the anti-trust case that they later dropped.

Apparently GGYC has now employed him too. You might think this statement will put to rest any ideas that the issues with SNG have been settled, because Boies is big-time!

Wasn't it Boies who made the appearance on Bloomberg news talking about the AC when this all started way back when?

This man is the primo anti-trust litigator in the country, and about the biggest legal gun there is. High-profile cases include Microsoft, Gore vs Bush and a raft more. I made the same comment before (here) and MM (of course) said that SNG were the richest club in the world, blah, blah, blah. I'll say it again, if I were a SNG member, I would sure as hell be asking what sort of D&O insurance and what sort of liability insurance we had and what sort of indemnity agreement there is between Alinghi and SNG.

This is awesome news for the issues coming down the road that have been talked about in the SAAC. Also, potential for another legal avenue mabye at the Federal level.

I expect JK to be around as there is too much AC history & NYSC background with Judge K at the NYSC level. I look a Boies coming onboard to expand the GGYC legal team & to take the issues coming down the road to a different level. He's an anti-trust specialist at the top.

TE was pretty specific on Boies mandate being "to protect our competitive interests, the interests of sailing, and of the Cup itself" MSP might be right about this going Federal. Looking at Boies background he is overkill for the state level.

I'm guessing that we will see Boies entrance into the battle maybe end of next week or first of the following week as the clock is ticking on getting any sort of Mutual Consent on RAK & etc. Maybe this big gun will force SNG to wake up & start thinking about being sporting & looking at Mutual Consent as this as gone too deep than any other AC already.

Boies is the Russell Coutts of litigation. And a very cool guy. Good stuff on him from Time and Wired.


I have been assuming that both the venue choice and powered systems decision will both be going back to court soon, with BMW having a significant likelihood of prevailing on both issues. Boies appearance indicates that this is accurate, and that BMW's likelihood of prevailing just went up even more.

SNG/alinghi have a different legal team now in the GGYC case compared to the initial TNZ action. If there are legal proceedings forthcoming, who is SNG going to hire to defend their position? alinghi went for a lightweight boat, lightweight is not what one wants usually in a legal team.

I would infer that communications with SNG/alinghi if any have made no satisfactory progress to date as far as GGYC is concerned since the last court session.
