Was about beating the other thread but the Pig prompted some folks to be flicked, and that wrecked the page count.  Then with LB still on the line but lost in a fog without any AIS, and nobody wanting to defend all the stupid stuff the WOXI skipper, it seems all is lost.  But Jack may have a plan.

You can be pretty sure that the maritime and taxation definitions are pretty separate. You can have an Opti for tax purposes. 

I will bet WOXI is owned by a seperate company, and the various Oatey businesses put money into it for sponsorship and advertising reasons. Given the high profile of the boat, for once, such expenditure is actually probably good value for money - unlike many. The expenditure is a bona-fide business expense. End of story. It wouldn't matter if the Wild Oats logo appeared on a fleet of 100 Optis.  

The question of commercial vessels and racing yachts came up a while ago in the face of Worksafe and workers compo. That is a can of worms no-one wants to open again. The most difficult are the occasional pay for a crew place boats - such as the ex-Kosatka VO70 that got pinged before the last race. Hey teacher I'm here to hand in my "essay".

WOXI is owned by the Oatley Estate. Whether WOXI the individual vessel is registered as a seperate tax entity or not is probably unlikely and probably irelevant. The simple fact is there are "cash or kind" transactions between the principal sponsors who vary year to year, but the main ones are Hamilton Is, Robert Oatley Wines, Channel 7, Audi and Henri Lloyd and with the Oatley Estate, owners of this floating billboard. Therefore transactions involving expenses for the former and income for the latter.

There are obviously many boats that have the above situation. However unlike some of the larger ones like WOXI, they are not on the Australian Shipping Register and have never ventured in the past "outside" Australian maritime regulated waters.

Francis points out there are also professional crew on board salaried or under contract and where their workplace insurance is something subject to State Work Cover requirements or arrangements involving a commercial insurer with also Australia Sailing's insurance to consider.

That all said there is nothing by all that alone which seems to automatically deem WOXI to be engaged in commercial activities (in a recreational event involving commercial activity) under Australian Marine Orders listed here or other regulatory requirements. There maybe some precedent who knows.

Therefore in the absence of that certainty it appears to be an argument only about the mandatory activation of AIS in terms of the SI's including a AIS specific activation reference and entrants having to comply with all appropriate regulatory requirements.

We don't know it but this subject may have been one reason for the RC to make AIS activation compliance mandatory.

I guess its the huge money/big boat fascination that people are interested in, this would hardly get reply if was a shit box getting protested by the gumboot bay YC  for not flying the right size racing flag or some AIS bullshit. But make it about  woxi and about 500 pairs of SA panties get seriously wadded anyway.

Toad let me be frank..you can even call me that if you like.

Mate that is a very good point about some Gumboot Bay YC in a race between gumboots flying flags. But the fact is that YC will never ever have one of their races sponsored by their local car tinting firm on National TV. About the only exception would be if a disgruntled member nuded up, stuck a firecracker up his arse and burnt the clubhouse to the ground.

Unfortunately with Channel 7's S2H coverage most can be excused for thinking WOXI is the only boat in this race. If they happen to catch a glimpse of the rest that is due the Channel 7 cameraman having a nervous itch or Delirium Tremens (DTs) brought on by rapid withdrawal from alcohol. If God forbid that happens those race viewers must then must think those other boats are just WOXI cheerleaders in hot pursuit.

This thread interest is of course exacerbated by WOXI's promotional contract with Channel 7 mentioned up thread, where this year one of the cheerleaders beat WOXI out of the harbour and another to lead most of the race. To offset that promotional contractural obligation and fuck up by WOXI, Richards came up with the story a Channel 7 Helicopter microwave link turned his AIS into a bucket of KFC. A masterful bit of PR as evidenced by this thread having 74,000 views in just 5 weeks and still going. What an awesome PR return on investment by just a couple slips of Richo's tongue from him having Tourette's.

Anyway mate I hope that gives you some insight into the panty split here, ironically started by the boat that came second, no one else.

Mate that reminds me. I should tell you the story of when as a kid I stuck a firecracker up a Cane Toads arse.

The most famous ocean racing yacht in the country wins the most prestigious race in the southern hemisphere run by arguably the the premiere club in that same sphere, technically in breach of the rules of said race by their own admission. But all we hear are crickets.

You may have hit the answer. Insurance. Insurance companies have a very different take on risk to the rest of us*, and when you need serious amounts of indemnity insurance you don't get to argue the finer points of what you will or won't make mandatory. 

The usual route that any sort of litigation takes is governed by the well known adage of "follow the money." In the face of an accident, given the modern litigious world we live in, the CYCA is going to find itself on the expensive end of an action. Turning up and mumbling something about AIS TX not being mandatory according to World Sailing's RRS, will get you exactly nowhere. In fact you would be well advised to not even mention it. The only tenable defense that stops their insurance company seeing the odd million vanish is one of best practice. If there is a safety tool, it had better have been turned on, or your litigant's lawyer will tear you into pieces. None of the arguments have anything to do with sailing. They have to do with legal precedent on one hand, and risk acessors on the other. 

*I have two relative who are actuaries. It is one of the most specialised areas of statistical mathematics imaginable. You need a university degree in statistics with outstanding marks to be even considered for entry into the actuarial courses. Then you are in for a few more years of intense study. Mere nerds need not apply.

Jack, good points about the myopic media. Having lived in only two countries yours and mine we share a common problem "petty sport nationalism" that where our collective media and public psyche thinks we are the best  ever. Its worse than that, it's a belief that any loss is a temporary glitch in the true order of things and will be restored in the next few minutes
