Down at my local chandlery the other day I noticed that they have a healthy supply of laser bits (the little ones like pintles, gudgeons, etc, at least that's what they have on display, maybe they have big bits in the back), upon closer inspection they are all marked "vanguard"...
I presume...
Basically, the response is that Kirby and associates are out to get LP/QM/etc. Kirby may or may not have actually designed part of the laser and definitely didn't write or hold copyrights to the CM.
There's an awful lot of "the defendant ________ denies" and "the defendant __________ does not...
You need the builder, you need the racers, you need the volunteers and people in the class organization, give me an example of any popular one design class today that didn't or doesn't have any of these.
In the past when you could home build yourself a competitive boat then maybe the builder...
So a complaint has been filed, should there be no response what happens next? I presume it gets picked up by some court or other, how long does that take?
Ok, not ISAF plaques, laser stickers. Point being that it is a laser hull that he stuck decals on, nothing particularly exciting about it and I'm surprised that it's taken so long for someone to post a photo of such...
The only bit I find fishy about the photos is that it's meant to demonstrate...
I think we all get that this is all about contracts, and contracts have also been signed to do with 2016 (maybe even 2020), but I could easily see ISAF revoking something from the laser class if they can't get a reasonable supply of equipment and boats sorted by then. IIRC when the selection of...
I think the difference is that with a copy of the CM in hand, the builder can say "yes, I built this to the exact specs in the manual". If the CM is taken away from them they'll be going on memory, if they say "yes, I built this to the exact specs in the manual" someone could respond "how can...
Something tells me if they try that, unless they have a really good reason (like the boats aren't produced for a long time in the cycle), the IOC will just pull away the medals for those events.
We just got through the crazy period of arguing over who gets in, I'd highly doubt that ISAF really...
Does that mean that somewhere there's a backup list of possible classes to replace the laser should everything really hit the fan hard and the boats aren't produced for a year or two?
And LP didn't like the idea of having to pay their direct competition for the ability to produce the product.
It will be interesting to see who actually owns the construction manual, if Kirby Inc owns every copy then it could conceivably recall them all (though I'd imagine that if they could...
My understanding what that the "Bruce Kirby Inc" part of that was to deal with exactly this kind of situation. It gives a super-simple change if he had been hit by a truck or decides to attempt to retire (which it seems he was considering before this blew up). Basically "Bruce Kirby Inc" is a...
It's a shame that people seem to not care at all that this guy gave them a boat that they love still 40 years on. I can see people complaining about his receiving money (and I'm not getting into that discussion in this post) to this day for it, but what has been proposed basically ignores the...
Ah, but there-in lies the problem they've stepped in. How do they guarantee that the new boats are built identical to the old ones when the old ones were built to a manual they no longer have (therefore can't guarantee the exactitude of their build) and they can't copy as that would be a breach...
My comment being based on the fact that I assumed they took into consideration that Kirby could/would try to make his own class and that ISAF would prepare to have a statement out quickly. If they didn't then they should be asking themselves why they didn't see it coming.
I figure your analogy...
