"A new Crew Nationality Rule will require 100% of the race crew for each competitor to either be a passport holder of the country the team's yacht club as at March 19 2021, or to have been physically present in that country (or, acting on behalf of such yacht club in Auckland, the venue of the AC36 Events) for two of the previous three years before March 18 2021. As an exception to this requirement, there will be a discretionary provision allowing a quota of non-nationals on the race crew for competitors from "Emerging Nations".
The only way a sailor of fortune can shift to a foreign team is under the Emerging Nations category. Only when the new Protocol is announced can it precisely determined what constitutes an "Emerging Nation." The matter is likely to be determined on a case by case basis, with the two Royals or ETNZ reserving the right to accept an Entry/Challenge from an "Emerging" team.
Emirates Team NZ are unlikely to leave the classification of an Emerging Nation matter open to the deliberations of a yet to be appointed Arbitration Panel to interpret the Emerging Nations Protocol rule.
A more straightforward approach is to reserve for themselves the right to accept/ decline entries, not in compliance with the 100% nationality requirement for sailing crew, or set conditions on their entry.
So, what does this mean for Alinghi & Ernesto? I means it will be up to Team New Zealand or the Royal New Zealand Yacht Squadron if they accept Ernesto/Alinghi as "Emerging Nation". It's in the hands of ETNZ/RNZYS if Alinghi can challenge for the Cup.

You are pretty NAIVE if you think Grant Dalton will let Burling/Tuke race for a rival AC37 Challenger!
They can get good lawyers to get them out of any contract if there is one. He can't control letting them leave NZ or cancel their passports.

Our own "damn country" has a covid/ vaccination problem to deal with before it even thinks about letting foreigners in. Let alone host an Americas Cup.
You really don't get it. Dalton holds the cards. He who holds the AC, calls the shots. And he has done since the beginning. Thats the whole point of winning it.

All they need is 11 sailors. Surely they can muster 11 sailors between their GC32 team and their TF35 teams. They have the Alinghi team, Team Tilt and Realteam to choose from.

Most of the Team Tilt & Realteam Members have been merged and will now be under the Swiss SailGP Banner with Schneiter as Skipper & Helm.

The present rules do prevent any sailors from moving, unless they have a passport for the new teams country.
Brought in immediately after the previous event, ostensibly to take the event back to its roots. The reality being it was to stop any Kiwi sailor being able to work for a foreign syndicate in a sailing position. It did not cover designers, which would have been more like the original events, as Kiwi relies on foreigners to perform this function.
So B & T are not able to move to a different team. What they could do is decide they have had enough and have no wish to be part of a team that abandons NZ and go for some other sailing achievements. For some time they have been mentioning other paths they could be interested in.
Not that they would do it, but what if they gave up Kiwi passports and went to another country?
Until we see the final wording of the protocol, we have no idea how that scenario might play out.
