Yup. Good for TNZ.

Less good for the team members themselves who cant monetize their success.....although Im sure they are well bid for other events.

Less good for challenges from nations looking for experienced talent to help get their team up to strength.
Nations with little Americas Experience will be allowed to hire foreign nationals. 
 

Experienced nations would include

Australia

USA

UK

France

Italy

Sweden

Switzerland 

Spain

New Zealand 

Japan

The whole of 2003 was an ugly affair, and ETNZ has a right to stop a repeat. 
Ugly on both sides IMO. I don't know about having a right but certainly ETNZ, as winner of the Cup, gets to make most of the rules for the next. If they feel the need to impose nationality rules to stop others buying NZ sailors then they can do so.

Germany and South Africa were also in the 2007 32nd Americas Cup. 

Arguably Australia might be an "emerging nation" as it is over 20 years since there was an Australian challenge. 

I jest because Sting raises a good point. What is the definition of an emerging nation for application of the nationality rule?

Will the definition be based on economic grounds, total sailing population, AC experience or something completely different......or simply the judge Potter Stewart test (for pornography) "I know it when I see it"?

Maybe it should be a simple rule, if your raced in an America’s cup final, your considered a first tier nation.

Or even a simpler rule based on population size, if your under 6 million you don’t have a nationality clause.

Latest gossip filtering through is that ETNZ B1 has been purchased (or is in process of) but they won't be employing extra team members until full protocol is released..... presumably if they're buying a hull then they're going to have some extra technical staff on the books already, not sure exactly how many people EB keeps on the books as part of the TF35 operation

I have always considered that the nationality rule would exclude Allinghi.

However if he found a yacht club in an emerging nation......that actually hosts an annual regatta , then he could challenge from that club with no intention of ever hosting a defense there.  It would make a nonsense of the nationality rule....

There is no way that switzerland can provide experienced bench strength fo a credible team ...and nor does it qualify as an emerging nation. Its a shame because a multinational team under a swiss flag would actually be pretty cool.

I'm assuming that EB plans to use the crew he has assembled from his lake foiling boats? maybe 37 will be a training run and he'll look to get some bigger guns into the team for 38 with time to tick the nationality boxes?? 

Theoretically is there any way to stop someone like Outeridge being employed as an 'external consultant' and acting as a coach and training helmsman for a team in 37 and then qualifying for 38 after logging enough time in country..?

Whatever happens, having Alinghi back in the mix will add an extra layer of intrigue and probably cause a few meltdowns on this forum....

Bertarelli already stated during the lead up to AC36 that a nationality rule wouldn´t be a problem for them. 

He said that the swiss sailing had gone a long way from the days when Alinghi first challenged for the AC and that now there are enough swiss sailors to form a national AC sailing team.
