This is a defamation case and they've all been deposed already I think, so it'd be pretty hard for any of these witnesses to claim there is a genuine likelihood that their answers would tend to incriminate them and if so that they haven't waived such privilege. That being said, some of the hookworm states still have some (never used) versions of criminal defamation on the books, so it's conceivable that the witnesses/defendants may attempt this argument.

If they prevail, the jury would be instructed that it can infer a negative response (for the witness/defendant) to any question for which they plead the fifth.
