Don't Blame Migrants and 'Open Borders' for Fentanyl Entering the Country

Despite the idea's sticking power in certain circles, it's inaccurate to say that undocumented immigrants crossing an open border are chiefly responsible for fentanyl arriving at the country's doors. In reality, U.S. citizens carrying the drug through legal ports of entry are primarily to blame.

U.S. Customs and Border Protection (CBP) has reported an upward trend in fentanyl seizures over the past few years. From 2,800 pounds seized in FY 2019, CBP seized 11,200 pounds of fentanyl in FY 2021 and 12,900 pounds in FY 2022 through the end of August.

Seizures conducted by two distinct bodies within CBP combine to yield those numbers. The first, the Office of Field Operations (OFO), enforces immigration and customs laws at ports of entry—points where someone may lawfully enter the United States. The second is U.S. Border Patrol, which intercepts undocumented individuals and illegally imported goods between those ports of entry.

The vast majority of fentanyl seized in recent years has been obtained by the OFO, not Border Patrol. The drug was mainly seized from smugglers at legal ports of entry, not illegal border crossings. OFO seizures amounted to 2,600 pounds in 2019 (93 percent of the total fentanyl seized by CBP), 4,000 pounds in 2020 (83 percent), 10,200 pounds in 2021 (91 percent), and 10,900 pounds so far in 2022 (84 percent). The Drug Enforcement Agency confirms the port trend, saying that "the most common method employed [by Mexican cartels] involves smuggling illicit drugs through U.S. [ports of entry] in passenger vehicles with concealed compartments or commingled with legitimate goods on tractor-trailers."

We put cartels in the fentanyl business by cracking down on "pill mills" and we can put them out of the business too, but not by looking in the wrong places. By decriminalizing recreational use of drugs.

Medical Marijuana Dispensaries Will Soon Open Alongside Florida Circle K Stores

This week, Green Thumb Industries, a Chicago-based manufacturer of packaged cannabis products, announced a joint agreement with Circle K convenience stores. By the end of the year, Green Thumb will build a 28-acre cultivation facility in Ocala, Florida. Then, starting in 2023, it will lease space in some Circle K stores to build its "RISE Express" dispensaries.

A Circle K spokesman clarified to CBS News that the dispensaries will be distinct from its convenience stores: "To be clear, Circle K is not selling cannabis in its U.S. stores." The dispensaries will operate out of separate storefronts with separate entrances.

The rollout is modest: Out of more than 600 Circle K stores in Florida, only 10 will see dispensaries. Green Thumb referred to it as the "test and learn phase of the rollout," implying that more locations could be forthcoming if the first 10 prove successful. In the meantime, relatively few of Florida's more than 750,000 medical marijuana cardholders will have access.

But despite the small initial numbers, the announcement is a promising one: While making it easier to purchase marijuana will be good for the patients who need it, greater access is a good step overall in ending the drug war. The more people are able to purchase marijuana from a credible source like a retail establishment, rather than illegally on the black market, the fewer people risk being sent to jail or consuming a contaminated product.

While Republican Gov. Ron DeSantis has not taken a firm stance for or against legalization, he told reporters that "it smells so putrid… I don't want to see that here. I want people to be able to breathe freely."

It is unclear exactly where DeSantis visited and found the smell of marijuana so overwhelming. Recreational marijuana is legal in 18 states as well as D.C. and Guam, per U.S. News and World Report.

Many places where marijuana ends up legal, DeSantis said, ended up “regretting it.”

“I could not believe the pungent odor that you would see in some of these places,” the Republican Governor added. “I don’t want to see that here. I want people to be able to breathe freely.”

Still denying the repeated replies to this thread over a period of years, huh? No matter, in this place, no one will question your lies even when proof is right in this thread. Anything is justified when it's a grabber going after a nutter.

But, when considering the stupid Reagan/Biden drug war, as with every other issue, it is important to recognize that I sometimes say bad things about TeamD gun bans and confiscation programs, so thanks for sounding your one note yet again.

Actually, we have regrettably stringent enforcement of the stupid drug war here in FL, and no, it would not be legal for me to just grow a few plants in my yard. The article I posted mentions a 28 acre cultivation facility in Ocala. So I guess they can get permission somehow, but I would not want to invest. Seems like something that drug war looters might target for forfeiture. I don't see what would stop them.

The moral logic of Biden's distinction between simple possession and other marijuana offenses is puzzling. He says marijuana use should not be treated as a crime. Yet he is willing to let individuals like Rubis languish in prison merely for helping people use marijuana, which today is recognized as a legitimate business in most states, 19 of which allow recreational as well as medical use.


That puzzle is compounded by the fact that Biden has acknowledged the injustice of long prison terms for growing or distributing marijuana in particular cases. Last April, he announced 75 commutations for federal drug offenders. The beneficiaries included eight people convicted of marijuana distribution offenses:

"No one should be in jail because of marijuana," Biden said while running for president. "As president, I will decriminalize cannabis use and automatically expunge prior convictions." His mass pardon did not accomplish either of those things, which are beyond Biden's powers "as president."

Decriminalizing marijuana use would require new legislation. Unless and until Congress acts, simple possession will remain a federal crime punishable by a fine of $1,000 or more and up to a year in jail.

As for expungement, it is available to people convicted of simple possession under federal law if they were younger than 21 at the time of the offense.

The article also gets into the sad story of Edwin Rubis, who has been locked up for two decades and will be for another decade. Another life ruined by the stupid drug war. One of thousands. People win awards for selling weed and Circle K is even allowing it near their stores but Rubis will be locked up until 2032.

Not sure if you're able to acknowledge that reality or if you buy into LB's lie that it was only a couple.

I agree that a single downvote isn't necessarily mindless and might be humorous, as yours seems intended to be. I think I've downvoted one post in my history here and it was something BJ Porter said that a bunch of us found it funny to downvote. I don't remember what he said nor in what thread.
