Until then, the misnamed fascists who call themselves the Federalist Society will continue to destroy America.

The court needs to be expanded by as many judges as required to not have it be a right-wing rubber stamp club. It's been done in the past, so there is precedent.

Should be a rotating system. 9 justices serve for 3 years or less. Each year a justice (or two) is appointed from a pool of rotating federal judges

50 SCOTUS Justices (51) rotating purely by luck of the draw on a case by case basis. 7 justices sitting on any given case. Each one serving only 10 years, and selected 5 at a time over 10 years. Each state would select 1 justice per their term. Replacement justices (in case of death, illness, or boredom) would only fill out their predecessor's term. No second terms, no matter what.
Sure, you could draw 7 liberals on one case, or 7 conservatives, but a couple of years later, when it's brought back up, it may be 3-4.....

How about a president can nominate two judges each term (one in January after a year in office, another two years later). Another two more judges the following term, regardless whether it's the same administration or not. Allow the SCOTUS to grow until it reaches 15 judges. After that each administration continues on the same nomination pattern, but with each appointment the longest serving judge is removed to keep the number at 15. If a judge dies or retires, the next one is nominated on schedule but none are retired.

In this scenario, a new judge is appointed every 2 years. If there are no deaths or retirements, a judge will be removed after 30 years of service, or a bit longer if a judge with less seniority dies or retires.

We are at a crossroads here it feels like. I think that's why the GOP is backing anything that brings voters out. Survival. They see the demographic change overall which is global really and they believe if they do not enable minority rule now, its gone forever and they may be right. If Hilary had won the world would be a totally different place most likely and not in the GOP's direction. There would be no war in Ukraine etc. But, due to this last election, the holes in the system have been identified as well as the interconnected nature of the global minority rule strong man movement. I believe the only reason Putin is still at this point continuing to push the Ukraine deal is that he believes there is still a chance that a trumptard could end up president in 2024. Russia is all in still on the cyber front in the US (and plain bribery?), the Saudi guy is raising oil prices (guess that nutjob didn't like what Biden told him), etc. China is passive.

The thing about the pendulum theory in my mind is that the center of the swing continues to move towards justice, fairness, inclusiveness, cooperation, and peace which has an inevitable conclusion of more regulation of greed, unfairness, elitism, etc. The greed heads have lots of money to try and keep it from happening but at some point they need go beyond the cheating they already do and change the actual game. The changing game part is happening right now. They cheated in 2016 with the help of a foreign govt but they can't do that again so they need to rig it. Thats what they learned in 2020.
As you said, the US is at a crossroads. The problem is bigger than the US. Social media, sensational click sources, fake news and intolerance are world problems. The result is nationalism and tribalism. We are a poster child due to our racist history and campaign finance corruption. We also have corrupt self serving leadership. The lens of history is cautionary, with a lot of concern we are facing something similar to the end of reconstruction. As you said, the GOP is valiantly trying to end representative democracy in favor of minority rule. They may succeed. NPR discussed demographic trends for the midterms, and voter registration by party. Young adults continue to passively post snapchats instead of demanding a voice. Education remains the biggest predictor of affiliation. Meanwhile, an Ohio preacher was arrested Friday for his part in the insurrection.

DOJ ‘closing in’ on Trump: bombshell NYT report suggests indictments are likely to ‘start flying’



On CNN Thursday, retired Harvard Law professor Laurence Tribe reacted to the news that the Justice Department believes former President Donald Trump is hoarding more documents on his property — a development that experts believe is a sign prosecutors are seriously weighing charges against the former president.

"What do you think where the Justice Department might be headed?" asked anchor Anderson Cooper.

"It certainly suggests the Justice Department is closing in on indicting Donald Trump," said Tribe. "Not simply for basically stealing top secret documents from the White House and secreting them in various locations ... but also for violating the Espionage Act and, based on this recent reporting, obstruction of justice."

Specifically, Tribe argued, the DOJ has evidence Trump is investigating both a "national security inquiry" and a "criminal investigation." "There are people whose lives are at stake if their identity has been revealed in some of these top secret documents, which clearly were marked 'human resource.' They were marked to indicate that they would reveal the identity or location of, basically, American spies abroad. They were marked signals intelligence. So this is very serious. And what I take these recent revelations to mean is that shortly after the midterm elections, indictments are likely to start flying."

"You believe that the Department of Justice might actually indict the former president?" Cooper pressed him.

"I believe that it might well indict the former president for obstruction, for espionage," said Tribe. "This is all quite apart from the possible indictment for seditious conspiracy and insurrection. I mean, it's as though he is building a moat around Mar-a-Lago and then trying to swim in it himself. Basically, with every stroke he takes, with every move he makes, he is digging himself a deeper, deeper pit ... his lawyers must be absolutely beside themselves because he makes matters worse. He says 'I want my documents back.' He brags about having taken them himself. Then he says the General Services Administration packed the boxes, but they deny it. You almost expect him to say my dog packed the boxes, except we know he doesn't have a dog."

As it has been said by almost everyone round here, repeatedly, any (US) citizen who had even tried to pull the BS that TFG did would have been jailed and subject to heavy interrogation within hours, not weeks or months or years.

If the USA wants to stay in lead of the free western world and NATO, you really have to step up your game. Power is nothing without control, and your actually powerless Ex-POTUS is still disturbing anything legal, democratic or decent.
