If The GOP goes after "Gay" marriage is not legal. Is any marriage legal? Wouldn't it put a big question on interracial, different ethics, different religions, different cultures, marrying for money, social statues or lack of, maybe age difference and so on. https://openyls.law.yale.edu/handle/20.500.13051/5652

The Supreme Court has adopted the doctrine of a constitutional “fundamental right to marry,” and has construed this doctrine to mean a fundamental right to state-recognized legal-marriage. However, the doctrine has several problems: (a) the Court never satisfactorily explains why marriage is a fundamental right; (b) the Court never defines the boundaries of marriage as a fundamental right; and (c) the Court has otherccasionally treated marriage as if it were not a fundamental right. Further, the idea of a “fundamental right to marry” contains a debilitating internal contradiction: the notion of a fundamental right implies firm privileges which the state cannot deny, define, or disrespect, but marriage boundaries (the legal rules establishing who is eligible to marry whom, what formalities are required for marriage, and the legal ramifications of marriage) in the United States have always been subject to almost plenary state control which denies some marriages and refuses to give legal effect to others.
So, if marriages are illegal then there is no need for a divorce, which would piss off a lot of lawyers and would really save at least 50% of married people a lot of money

"Debilitating internal contradiction" is an elegant and accurately descriptive phrase. Not so great as a band name.

And I don't think it makes Republicans bat an eye. They're so accustomed to getting bitten in the ass by self-contradiction that they don't even notice it any more; or if they do, they take as proof they're RIGHT!!

A first year pre-law student using pretzel logic to try to sound impressive.
"Marriage" according to many fundamentalists, is a union whereby the wife(female) is obedient to the husband(male) and the union is formed specifically to enable the husband to carry out his daily tasks w/o having to pay a servant for services such as cooking, cleaning, and tend to his needs in times of ailment. The woman was expected, indeed, to contribute to the household wealth via her dowry.
The wife's duty is to do the household chores, and bear children, and raise them to contribute to the wealth of the husband.
In many societies marriage is arranged at birth, or shortly thereafter as a form of legal, and social contract. There is nothing about loving, cherishing or honoring except that the wife is expected to honor and obey the husband. The husband, in many cases is expected to have several concubines, who tend to his sexual desires, and often provide more servants to the house in way of bastard children.



As I once (at least once) said to a person who was arguing against gay marriage; "Why would you want to deny gay people the right to be as miserable as the rest of society after a few months?".

I have a T-shirt... a present from a friend, I did not think of this or get it for myself.... that says in big red letters "STOP GAY MARRIAGE" and then in small pink letters underneath, it says "haven't they suffered enough already?"

After President Barack Obama finally gave his explicit support to gay marriage in May, The New York Times claimed it was the culmination of "a wrenching personal transformation on the issue." If so, Obama changed back into the person he was in 1996, when he was a political novice running for the Illinois Senate. "I favor legalizing same-sex marriages," he told a gay newspaper back then, "and would fight efforts to prohibit such marriages."

Running for re-election two years later, Obama already had learned the value of reticence regarding touchy social issues. "Do you believe that the Illinois government should recognize same-sex marriages?" a questionnaire asked. Obama's response: "Undecided."

Evidently the wrenching decision Obama had to make was not whether he thought gay couples should have a right to marry but whether he should say so out loud. The fact that it took 16 years reflects the gradual evolution of public opinion on the question, which ultimately made it thinkable for him to tell ABC News "it is important for me to go ahead and affirm that I think same-sex couples should be able to get married."

The immediate impetus for that affirmation was the fallout from Vice President Joseph Biden's unguarded comments about gay marriage three days earlier, which drew unwelcome attention to Obama's studied ambiguity on the subject. "I am absolutely comfortable with the fact that men marrying men, women marrying women, and heterosexual men and women marrying [each other] are entitled to the same exact rights, all the civil rights, all the civil liberties," Biden said on Meet the Press. "And quite frankly, I don't see much of a distinction beyond that."


Obama did—or at least, he was aware that many voters did, which is why he had been careful to avoid endorsing "gay marriage" as such. Instead he advocated a "strong version" of "civil unions," one that would give gay couples "all the rights" of straight couples, except the right to call their relationship a marriage.


Obama understood that the name really does matter to some opponents, mainly because they conflate civil marriage—the legal arrangement recognized by the state—with "the sacred institution of marriage" (as Republican presidential nominee Mitt Romney calls it), which is defined by religious traditions that date back a lot further than marriage licenses.

When considering gay marriage, as with every other issue, it's important to note that I sometimes say bad things about TeamD gun bans and confiscation programs and it's almost as important to make the leap that I'll support any fascist TeamR type, so thanks for adding your two cents!

Thanks, It spark a thought, I was a TeamR mid 2000's, Then it seemed team R wanted to control who or what you were/are. The one teamR friend I have seemed to always want to control who and what I am.
The other day he tried to set up an attractive bartender woman with his son/friend. "oh you 2 would make a great couple and have great kids. She declined politely at first, but he kept at it. and not knowing her story, just pretty woman should get married and have kids (as per the Church and teamR) she was getting pissed, I changed the subject.
Catholic/TeamR? Just don't get it, make Abortions illegal and they are none, wrong there were more before Roe.
Make Gay marriage illegal and there are not more Gays. Shit gays have always been on this planet
These are all just a distraction to keep people think that teanR's are good honest people while there stealing from us!
If there is a GOD? I hope he does a better job with the next civilization, because he fucked up this one
