That's my entire point. If the guy was just part of the rally and didn't break any laws, then there are no grounds for the school to suspend or sanction him. That would indeed be a violation of the 1A since the school is a gov't run and federally funded entity. Plenty of folks have been to BLM rallies without breaking any laws, myself included. Ours was to protest the confederate soldier greeting people at the front door of the building where people seek equal justice under the law. If the article is correct then this guy who has been on the receiving end of RW lunatics in the Jade Helm conspiracy as one of the planners of the exercise. And even the lowest ranking guys are capable of independent thought and decision making when cut off from the chain of command.

Exactly.Technical question for those that have watched more of the videos than I; from what I saw it looked as if there were 3 layers of control, an outer barrier, the inner barrier at the steps of the Capitol and the doors and windows of the building. Is this correct? Certainly, anyone that was at the TOP of the steps was trespassing as they would have gone through the barriers near the bottom of the steps but if there was a control barrier further out then anyone near the steps would have been trespassing and chargeable. So if the teacher was on the steps then he was certainly not 'protesting" legitimately but trespassing and subject to disciplinary action.
