There will be a verdict in the German court case against Twitter on Dec 14th.
And yes, as everyone but Elmo anticipated Elmos tweets played a role during oral pleadings last week.


Looks like Elmo twittered 100% against what his lawyers were arguing that day. Oops. Reportedly the court had some trust issues after that.
Who can trust Twitter that illegal content will stay down after notification if take downs and bans get reversed by Elmo at any time? Looks like we'll find out if court ordered sanctions help.

The chamber is hearing newspaper/media stuff, the applicable laws are in that area. The goal is to get an injunction that Twitter has to remove defamatory content that is the same or substantially the same. Also known as "stay down".

"Substantially the same" is the interesting part and a would be a first against Twitter.
In old media this is the usual outcome, after all it was too easy for a newspaper to simply reword a defamation every time they got a judgement against them. Courts and legislators got bored of that real quick and laws were changed a long time ago.

Turns out Elon is working hard on the development of the law in Germany. Who would have thought...

Over the past week, Twitter owner Elon Musk has been poking Apple, the big bear of Silicon Valley, which controls app distribution to every iPhone.

Musk has been taking aim at the iPhone maker over a number of topics, including its reduced spending on Twitter advertising and its 30% cut of all digital sales made through apps. He also accused Apple of threatening to pull the Twitter app from the App Store.

Musk has been taking aim at the iPhone maker over a number of topics, including its reduced spending on Twitter advertising and its 30% cut of all digital sales made through apps. He also accused Apple of threatening to pull the Twitter app from the App Store.

What's his leverage? If Apple goes, Android will too. Musk is going to have to come up with a TwitPhone pretty quickly.

The phone isn't the hard part, he can likely license an Android system, or maybe buy the old Microsoft OS. The hard part is the app store. Who will want to buy a phone that can only run one app? Doggie Deux and Joker, ok, but that's a limited market...

A little personal history about the beginnings of Tesla.

In early October 2002 I was driving my rather 'breathed-on' silver Audi TT, license plate ROQUETT, at high speed along Alameda de las Pulgas here in Palo Alto. I was passed by another TT, license plate ROCKITT. I gave him heaps of lights and he pulled over. It was Martin Eberhard, whom I'd met in his WYSE days. We agreed to have lunch soon at Bucks in Woodside, a famous eatery. Jamis MacNiven, the owner of Bucks, took the photo below. Martin to the left, me to the right.

We very soon got stuck into automotive talk. I was heavily into cleantech at the time, and suggested that Audi build an electric TT. Martin dismissed this, quite rightly, as the TT was far too porky and heavy. It must be carbon, he said. We discussed powertrains for a bit, and then decided that the limiting factors would be batteries, electronics and the motor.

Anyway it was a fine long lunch, and we've had several more in the last 20 years.

I got a call a few months later from Martin, who said "You'll never guess what we're up to!" Sure enough, Tesla Motors.

I helped them with some of the squirrel cage motor design, and some early marketing concepts. I drove both pre-prototypes, the yellow and blue ones. We once came to the lights on Sand Hill Road next to a brand new Porsche 4S, and just destroyed him up the hill. It was like a rocket strapped to your buns.

Elon? Elon who?

I ate there! I also stood in line at the woodside market getting snacks on a Sunday morning bike ride with John Skully who was shagging a New York Times. He had just started at apple and I asked him how it was going. He grimaced and shrugged his shoulders and didn’t say a word.
