The rule exists for shitty behavior exactly like Mr. Shubrook.
It is an odd rule. In my youthful exuberance, I have slid down the roof of beer tents, fallen off stages, been in fights, packed scums in yacht club bars , thrown drinks in fans and on three glorious occasions, been arrested for after race antics (the Gladstone constabulary had a hair trigger over the Easter holiday period back in the day, particularly towards groups of drunks wearing the same shirts) yet the only time I have been threatened with a rule 69 was for calling someone a muppet on social media.

And yes I was a throughly poisonous lout.

Result of Rule 69 Hearing

On July 6, 2022, the Protest Committee conducted a rule 69 hearing against James May.
As a result of this hearing, the Committee has determined that James May has committed misconduct under rule 69.1(a).
The Committee has penalized James May by reporting its findings including the facts found, its conclusions and decision to his national authority US Sailing, and to the 2022 Bermuda Race Organizing Committee.
 
Yea I went last year too, what a slog that was! We tested in the morning and were cleared by the evening. On the island nodoby cared about covid.

My issue was not with the bermuda officials but with the race officials. I'll post it eventually but it would be foolish to give them a sneak peak at my arguments.
