What's at stake with NBR Misconduct rule 69?

Wow what route?
Back in the day there used to be a Bermuda to Toronto race.
First half - pretty straight forward, second half was always anyone's race.
via charleston then bermuda.. they spent 12 days quarantiened in a toronto hotel room where they weren't allowed room service, they had to uber in all their meals... from there in order to get back home quickly, he had to rent a car to drive across the border , spending 6 hours on the road so he could fly out on a US airport... they wouldn't let him fly out of toronto.. and once they got back, his wife had complications, spent 8 days in the hospital and may end up on home dialysis for the rest of her life...

It seems the people who want this guy hung out to dry mostly want it because of his anti-mask motivation, as opposed to his actual conduct. Although I understand his frustration, I won't defend his conduct; it was childish at best and certainly deserves some reprimand. We have seen much worse conduct from sailors, both pro and amateur, yet people have not called for Rule 69 and some have often opposed it.

So, why is his motivation relevant? What punishment do you see as appropriate for his actual conduct?
well someone mentioned caning, but we don't do that here.. which is a shame.. it seems "rudeness" is the norm for a group of entitled people, a swat across the ass would go a long ways to cure that... like a great american said "spare the rod....."

In the early Jamestown Virginia settlement, one punishment was to pitch the rude offender into the marsh mud in front of the entire settlement.

My issue was not with the bermuda officials but with the race officials. I'll post it eventually but it would be foolish to give them a sneak peak at my arguments.
Yes those antivax youtube vids should make a very convincing argument. 'I flipped the table and acted like an entitled cunt because covid is a hoax.' The only pity in all this is that the penaltys for a rule 69 infringement don't include sodomy.

2 weeks community service in a covid morgue. After being repeatedly anally rapped in a prison toilet block of course.

Yea I went last year too, what a slog that was! We tested in the morning and were cleared by the evening. On the island nodoby cared about covid.

Yea. I'll consider myself in good company if I get banned from the royal bermuda yacht club but If I don't face these people they will just escalate and try and ban me from everything.
This is one of the most laid back, fun clubs in the world. You have to be a serious jerk to get banned from RBYC. This is the club that invented the Loudmouth cocktail and the RBYC cocktail. This is the club that owns a top loading washing machine for making cocktails on the lawn at regattas. This is the club that races the utterly extreme and crazy Bermuda skiff. This is a club who had a 30 something sailor as commodore who can party as fast as he sails. This is a club where when you cannot remount your scooter, instead of calling you intoxicated and sending for the police, a club member cheerfully offers to drive you to your hotel.
I am interested in that seeing list of "good company" that you want to join.

It sounds like you are not at all confident in your arguments. You obviously are worried that if they have time to think about them, they will discover the holes.

Word for you....trying to spring a surprise argument is not going to work.

Just to set the record straight, but there doesn’t appear to be an actual “Mr Shubrook” in the crew list.

The Rule 69 hearing notice that was emailed was in regards to a “James May”.

A ”James May” was listed as crew on “USA40878 High Note”, a Baltic 51
, in the printed Crew List distributed the day before the incident, but is coincidentally absent from the final, online crew list.

I still can't believe this happened ahahaha what an absolute buffoon to do this in the first place nevermind then posting it to a public forum. Hope this guy can't get a ride for the life of him. Zero respect for the volunteers, OA, US Sailing, Bermuda, etc. "holier than thou"

edit: should add that one's personal beliefs on masks etc has zero bearing on this incident. Competitors should be expected to behave professionally. After this guy's comments on safety, I wouldn't let him within a mile of a boat I was running. He's a liability. Crew was better off without him in the conditions we saw out there.
